Help with VF, maternity rights & bank hols

Wondering if someone (anyone!) can help.

I've just accepted VR from a civil service job. I have been on maternity leave for a year and my last day of service and my last day of mat leave were the same day so i didn't have to return/ use any holiday.

It was my understanding that during the period of maternity leave i would accuse BH and privilege days (queen's bday etc) and i would be able to take these as A/L if I returned to work. However since I have gone on VR there seems to be a query as to whether i am entitled to be paid these days. They have accepted paying the accused A/L but not the BH & Priv days. My manager has agreed that I wasn't able to take these during the year as I was off on maternity leave. Can anyone advise further on this? Im not sure if they are right or wrong, but obviously want to chase them up if I am owed the days. Thanks very much :)

    I think you mean accrue/accrued not accuse/accused!

    Sure some of the legal peeps will put you right but I believe there was a case in the ECJ relatively recently.

    Did you have 3 months on nil pay as part of your mat leave?

    So you could have stopped maternity early and used the holiday and still not returned to work.

    Money would have been the same.

    Good point, notice should be paid in full (subject to the exclusion) so if it ran concurant with the maternity it should have been paid or PILON.
  • I applied for the redundancy voluntarily and I found out i was accepted on 8 September and the last day of service was 31 October. Er, yes, in theory, could have stopped maternity used accrued leave but hadn't really thought about it like that. Does that mean that I would no longer be entitled to it? Thanks for your help

  • So during that period (following finding out that I had been successful) I wasn't paid any salary but I was paid a tax refund.

    Hmmmmm. I also took VR from the civil service this year while on mat leave. I was actually on SMP when I had the decision, gave up the rest of my SMP (only about 6 weeks) to go back into full pay for my 3 months notice. I didn't get anything extra for leave etc because it was taken during my notice period (in theory). But had I gone back to work for the notice period I would have had to use my accrued leave and BHs during the notice period.

  • Thanks Mildred. I am wondering if I should just check with the union. My LM accept that I wasn't able to take it, its just getting payroll to deal with it.
