Credit card dispute help

Hi, i recently purchased an iphone from a website that turned out to be not as it seemed. On the website it stated 5 days delivery and after 3 weeks the phone didnt arrive. I contacted the company many times with no replies so i contacted my credit card company (barclays) and started a dispute. Thankfully after 4 weeks of hard work barclay put the money back on my card subject to further checks. After a few days i surprisingly recieved my iphone... And found it to be a fake. This was not stated on the web site. I am now terrified to contact my credit card company to say i got the phone incase they take the money back of my card and tell me to sort it out with retailer. I dont want a fake phone and just want my money back. What should i do? Help please!

    You already had a refund from Barclays ? So you now have a fake phone that you haven't paid for ? Not sure what you're wanting really.
  • I think you do have to do something.

    The danger is that if you "accept" the phone, then eventually Barclays could re-charge it.

    If it's a UK supplier, I would simply exercise distance selling rights as the simplest way to return the goods. I'd also contact trading standards.

    If it's a foreign supplier, I would sent it back anyway, keeping evidence of its return. I'd also take a few pics.

    Put the fake phone somewhere and forget about it. If the company concerned demand the phone back through non-payment, then post it back. Otherwise, don't bother. If it's a UK company, you might want to take the phone to your local trading standards, stating that you have already received a refund from your bank.
  • Yes i have a refund but pending further investigations. I am scared the credit card company take the refund back after they find out i have the phone. The website is foreign (THailand) and has no contact methods on site except email but they do not reply. Should i contact credit card company and say... I have the phone but it was miss sold to me as it is a fake. Would they still refund my money or will they tell me to send it back to company and get refund that way. that will be impossible for me. I really dont know what to do. Should i just wait for the credit card company to get back in contact with me. Any sufgestions would be great. Im very stressed! :)

    How did the phone arrive to you? Was it send by a registered service that you had to sign for? If so, then they can claim when they receive proof of delivery (If they are still going then) or they might just leave it be.

    Considering the company is in Thailand, I'd just wait for the your CC company to get back to you, if they ever do. Keep the phone in case you need to send it back. If the CC company ring you back saying they will redebit, then explain the fact of the fake phone.
  • If it was over £100 then you have s75 protection and your position with the CC is safer.

    I was offered my first Rolex there in 1993. About £5!
  • The site appeared to be british and they said they were a uk company and had .co.uk it all look genuine at the time.

    How much cheaper than normal UK list price was it though - that's usually a good hint that it could be fake or otherwise dodgy.
    loose does not rhyme with choose but lose does and is the word you meant to write.

    As you have received the phone it is possible that Barclays may hear from the seller and redebit your account. However as this retailer is obviously dishonest, you may be lucky and they may never contact Barclays so you could possibly keep your refund. I'd wait until you hear from Barclays. The retailer has up to 60 days (from the date the chargeback was actioned) to represent the chargeback so if you haven't heard from Barclays after that time you should be ok.

    Important question has been asked, how was it sent to you?
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
