no union rep as my grade is a higher level from what I can see. .

Do you mean you are not a member of any TU because you think your job grade is too high? Or do you think a Union rep would only be interested in the problems of lower level staff?

If you are not a TU member then it's too late to join one for your current situation. However you should seriously think about joining when this is over and you are still there or in a new job.

If it is that you are a member but aren't getting help because of your grade, contact your regional office first thing on Monday.

Thanks no union rep as my grade is a higher level from what I can see. Not been there long enough to know what else there is and also not enough time to find a collegue that may be willing to sit in with me. Occupational health just said go back to work and face the hearing! Just feels like a huge joke at the moment. A netrual reference is all I want so i can on with my life so will aim for that.

If you wait until the disciplinary hearing to ask for this then there is no incentive for them to agree. They are already there and may as well sack you. This strategy has one shot, and one only - you ask now. Whatever other people here might think.
  • Diary = . I did not change any records or such just didnt keep my bosses as up to date as they would like.

The union recognised by the company only for grades below mine. The is something else for the higher grades that I dont really understand but too late now.

I will look to ask to be able to resign today. Thanks

It is irrelevant whether the union is "recognised by the company" or not. You have a legal right to join any union you choose and a legal right to take any accredited union rep to a formal meeting. The company cannot refuse this.

Anyway, as you say too late now.

You are off sick. That means you need to recover. So use the time between now and the meeting to doexactly that. That is all they expect of you. That is all anybody expects of you. You messed up and are not perfect. Because you are not perfect you regard yourself as a failure and must walk away by resigning. Is getting the sack worse than resigning from a future employer's point of view? I am not so sure it is.

    I agree.

The ONLY advantage in resigning in these situations is if you do so in exchange for an agreed reference.

As I think somebody said earlier even this can be difficult to enforce unless it forms part of a formal compromise agreement and there is no obvious reason for the employer to get involved in the cost of producing one in this case. However, at the very least, try to get WRITTEN agreement as to what any reference will say.
  • Hello

Have resigned today with immediate effect. This will mean any reference will not mention the disipliniary. I am told the standard reference is the very basic ie confirming dates worked. Not happy that I am unemployed for the first time in over a decade and for stupid reasons but Im sure Ill get through this and it will be for the best.

Many thanks to those who took time to read and respond.
