PCN for parking in an unsigned bay

I received a PCN last weekend from Waltham Forest council.

I parked my car in a marked bay at the side of the road, having checked around for any parking restrictions to make sure I was safe.

When I came back I received a ticket for the following contravention:

"Code 12S. Parked in a residents' or shared use parking place or zone without either clearly displaying a valid permit or voucher or pay and display ticket issued for that place, or without payment of the parking charge (shared use bay)"

I was very confused, so I had a further look around. Apparently this road is within a CPZ, but I thought they only related to parking on roads, rather than in bays? One of the sites linked from the Parking Ticket Appeals page states the following: "Where there are parking bays at the side of the road there must be signs every 30m along the road. There should also be signs within 5m of each end of the parking bays."

The CPZ signs WERE hard to read as they were obscured by trees from all but straight on, but leaf fall since getting the ticket and getting a camera has made them visible again.

    No, CPZs are typically used for no waiting / yellow lines but they can be used for parking bays too. CPZs are a pain in the grass. I used to enforce one at my old job.. the number of motorists that you'd get "having a go" at you was unbelieveable and unlike some areas our CPZ signs were plastered everywhere - you really couldn't miss them but not all areas are this good. Some areas have signs covered in mould, buried in a bush etc etc.

    Worth taking a look around and trying to find defective signs. Failing that just write in and plead how sorry you are. Many councils offer an unofficial policy of letting the first PCN go for a genuine reason. Thats probably getting harder to come by at the moment due to budget cuts etc but i know of a few that have an agreement between each other to sing from the same sheet. If they write back saying no then you can still take the PCN to an adjudicator but you'll need a pretty good reason.
