When is a fraud not a fraud?

  • It's not a fraud issue. You don't have to prove fraud in order to dispute a transaction.

It is up to the CC to prove that a transaction was authorised, not for you to prove that it wasn't. This could be legit, mistake, fraud, systems failure etc.

It may indeed be true that the merchant has your details from the initial transaction, but NW aren't entitled to rely on this as proof that the transaction was authorised.

The previous posters are probably correct - you may well have agreed that further charges could be passed on. You really need to see the wording. Subsequent transactions would only be authorised if they were provided for in the original agreement.

So I would continue the dispute (for now) until you have received information as to what the charges are for and that they are within the scope of the authorisation.

This may all be very inconvenient for Nationwide having to raise this dispute through the visa network. But that's tough - the visa/mastercard networks choose to allow this type of authority (CPA) so they can only expect hassle from time-to-time if merchants are less than transparent (at best) or try it on.
  • Nationwide gave me an email address for me to contact and ask for details of this disputed charge. I sent an email 2 weeks ago, but (surprise, surprise) they have not answered !!

I'd phone them if i were you, have you checked your contract ? How much is the amount, it's more than likely to be for refuelling, damage to the car or a speeding/traffic violation. 2 months after the hire is not really unusual for car hire companies to debit an account. If it's a car hire company with offices in the UK, call them, they will check out what it is for, for you.
