unsold property

I am wondering if anyone can help me please. I have lost my Mum and her flat is taking some time to sell. The flat is in a block where there is a monthly management fee payable monthly. I can no longer afford to pay this and the management company is threatening legal action. All money is tied up in the property. I received this letter today and now its the weekend I cant do anything until monday. Does anybody know where I stand or if there is anywhere I can get advice over weekend. My stress levels are through the roof. Thanks in advance.

  • I replied to your post on the other forum.

    Any outstanding service charges and fees will need to be paid either upon sale, but usually they will be negotiated as part of the purchase price. If the property isn't sold within a reasonable time the agent could apply to the court to have a charge put on the property. This could take some time, so meanwhile drop the price so the property is the most reasonably-priced and attractive of all the flats in the development.

    Do you live in this flat or is it vacant? This debt i believe is not yours it is your mothers I think your mistake has been paying the management fee you need to get a solicitor to write to the managemnet company to say that your mother has died and that until the flat is sold you cannot pay!
  • The fees are the liability of the deceased's estate.

    Additionally Mums estate effectively owes the OP any fees she has paid re management costs - which will be applied (as will all os liabilites), before the disposal of the residual estate.

    I would get some advice from a Solicitor, and have them draft a letter.
