Help! Benefits to stop

Hi all
okay, long story short my Mum and Dad left their home to rent it out and live for 10 months at a caravan park.
My dad left my mum on mothers day, she is in the caravan and the park will close Jan 2nd. She no longer works and was receiving incapacity benefit which she has been told will stop in a fortnight.
dad is not helping her, at all, apart from paying for the odd gas bottle - it is a very bitter break up. He has offered a measly £30 a week, saying that the ground rent that he paid for the year is another £50 so he's making it look like he's allowing her £80 a week. God knows when she would see a penny of it if I'm honest.
The issue is, her Doctor is to help her by writing a formal letter to notify of the following - I don't live nearby and think that she mentally can't get over the situation and has been referred to a phsyciatrist. She can't afford to heat the van so will no doubt be making herself ill in that respect but she mentally is not coping.
Citizens advice is closed at this time of day so can only go on their website but I don't know what to do.
As someone on no income, with no benefits apart from the one that pays for prescriptions etc which is only recent, and no offer of housing, she can't afford the rent so will absolutely have to move out. But is there anything that she can claim for, surely the government wouldn't leave anyone with nothing.
Does she have to declare herself homeless to get anyone to notice, because technically she will be when she can't afford the rent.

is the family home still rented out?whats happening to the rental income if if it is?why has her IB stopped is it because cont.based has ended?if so why doesnt she claim income based IB?
if there are no children involved then your dad doesnt have to keep her,she needs urgent legal advice about a divorce/legal seperation,she needs to see a solicitor asap0 -

There's no such benefit as income-based IB but there is Income Support top up but it depends why her IB has stopped? How old is your Mum?0

Thanks for your quick replies, it helps. Her Doctor rang her just now and is going to help her fight it - he says they should have contacted him about her health, not just done their own assessment...
woodbine, thanks for that post - the property is still mortgaged so no income, it just pays for itself. Dad is speaking to the tenants because they raised an interest in purchasing it
lady gaga! no, I don't know who would murder who first her, or the hubby =D In all seriousness she's a stubborn thing and won't move away - she has built up a good circle of friends and I guess it would be scary for her.
Von the IB stopped because their assessment showed that she is no longer incapacitated, she is 53 and left work when she got ill - hidden lots of the facts away from me but all coming out now!

I assume they're transferring her from IB to ESA and has failed the Work Capability Assessment so her only option is to appeal against the decision and they'll continue to pay her at the assessment rate (£67.50 per week) until her appeal is heard. She'll need to ask for Form GL24 from the Jobcentre or download it from here http://www.direct.gov.uk/en/Diol1/DoItOnline/DG_4017514 then complete it asap and send it to the Benefit Centre.0

Just to check - which country does mum live in - Scottish law is very different.
When did the tenancy on the hgouse begin, what is the rental period?
Is there a gas safety certificate, if there is gas?
Is the deposit protected properly?
Do your parents have landlord's insurance?
Have they properly declared the rent to HMRC (even if they make a loss they need to do that)?

Because..............
Evicting a tenant in Scotland can be more difficult than it is in E+W.
Rental periods dictate notice expiry.
A gas safety certificate is a legal requirement, a requirement the tenant may take advantage of if they wish to delay eviction.
If the deposit ISN'T protected properly a S21 cannot be issued.
Landlord's insurance may mitigate against the damage a vengeful tenant may cause on exit.
Former tenants have been known to report landlords to HMRC.
Mortgage providers may call in the loan if renting without their consent to let.
There is a property that could easily be made available to the OP, provided the kind of issues raised are dealt with properly. It would certainly avoid any imminent homelessness which, I thought, was the point of the OP.0 -

sorry I can't reply to each individual post, its a bit late and just wanted to thank you
the comments regarding the 'lease' on the house, well thats due to be up shortly, they won't be evicting anybody - in fact hoping the current tenants will buy, otherwise they will not renew the tenancy so that they can sell. All of that is legal as should be so no worries there, basically if the house sells they will be fine, however the area is lovely but takes time to sell property so back to point 1. no money, what to do
I will thank you all properly tomorrow, in the mean while it might be good to hear about what help she can get financially, if at all, before the house does sell and before she has to declare herself as homeless - no income, no supplies and no heat for winter
