did courier swap item? advice needed please

im a member on a car forum and did a deal with a member there for some part worn tyres, before parting with my cash (£250) i checked out his ebay feedback and also his activity on the forum and also another forum he is a member of, all seemed fine. He described the tyres as over 5mm and in excellent condition. I received the tyres and they had less tread than stated and under closer examination, there was bad damage to the inner walls of both tyres, basicly, the tyres are scrap.
I took pictures and a video and sent them to the seller, he states that he is 100% certain they are not the tyres he sent. He seems like a legit guy and says he will take it up with the courier company, meanwhile, im £250 down, and wondering what I can do.
seems pretty far fetched that somewhere at a courier depot, someone saw the tyres and happened to have the exact size ones of those being sent and had the time to go get them, swap them over and then send the damaged ones to me.
I asked him to refund my money because the dispute is between him and the courier, but he says he wants to see what the courier says first. Id just like to get other peoples opinions on this and what my options are if the courier company dont accept resonsability.

    Sender's problem - he should refund you and sort it out with the courier firm - come back to you when hes got it sorted to try again if you/he wants.

    I wouldn't be too quick to blame the courier.

    At £250 for a pair of partly worn tyres, I wouldn't imagine that they are a common type and as you stated, what are the chances that someone working at the courier company would have had a pair of tyres of the same make, same design and ready to swop with the ones that you should have received?


    When they were delivered, were they totally wrapped up?

    How did you actually pay for the tyres?

    i paid bank transfer, the seller said paypal to begin with, hes said that if he was trying to rip me off he wouldnt have suggested paypal

    i have to laugh :rotfl:at that as paypal is one of the places that are used by fraudsters.

    with tyres a pic does not show the true state of the tyre. you should physically see these before handing over money.

    why was the seller actually selling these, most likely they were worn and he replaced his own.

    maybe, but you have to admit any case via paypal would have gone in the buyers favour 'Return item to seller, provide tracking, refund issued to buyer'.

    yup better than a bank transfer as you have buyer protection.
