I know its an awfull thing to do but...

Ive finally seen a property Ive fallen in love with. It came on the market on Monday and I rang up immediatly for a viewing that day but the vendors couldnt do any till wed. I had a funeral on wednesday as I informed the EA and was working thurs, fri so we organised a viewing for saturday. I get a phone call friday to say the vendors are still happy to have our viewing but they accepted an offer on Thursday. I asked if they were happy with the offer and he said yes.

Firstly I am mad at EA for not phoning me after the offer was made as he knew I was extremely interested. Plus Id of offered the asking price as I loved the house.

Secondly I went to view the house and the vendors agreed they'd sold the property but did a very good sell to us still on the property and said if we had any more questions or would like a second viewing just ring EA????

So am I missing something and there may be a chance of getting this house or am I just hoping as I love it so much and nothing will ever compare again(Ive been looking for 7 months). I even thought of GAZUMPING the buyers and offering over the asking price but it would leave us skint.

The house is 100 times better than anything we've viewed and Ive viewed over 100 properties in the last two years.

PLEASE PLEASE somebody can you read in between the lines here and give me some advice as I cant concentrate or sleep!

    Do you know what position the other people who have offered the asking price are in? It might be that they have to wait to sell their house before they are in a position to proceed with the purchase so you might be in a better position? Do you have a property to sell?
    Still worth putting your offer forward, I suppose you just have to be careful that they aren't hoping you'll get into a bidding war. Good luck!

    I don't think that I would class it as gazumping at this early stage.

    Put the offer in, the vendors probably thought that they accepted the offer to quick and probably regret it now.
    Be prepared that if they take your offer, they may just as easily phone you in a few days saying that someone else has topped your offer.
    Well life is harsh, hug me don't reject me.
  • The Agent is acting on behalf of the seller, therefore whatever the seller wants to do the Agent has to agree to it. The position of both parties will be taken into account and advice given, but altimatly its up to the seller.

    Not many Agents like to get involved in bidding wars because it causes hassle and one party is bound to be upset. If you are in a similar positions with the offer people then they may ask for sealed bids on the home. This means you write a letter giving your best and final offer in writting to the agent and they are opened at the same time, however, its not legally binding as no contract is exchanged but it may sort the problem out.

    I think you're okay to make the offer icklejulez; at this early stage the other buyers will not have spent any money and so it isn't gazumping in the true sense - just get in there quick before they pay the valuation fee.

    If the seller was happy for you to still go and view, presumably he would also be happy to consider any offer you were to make.

    Just a thought - you may not need to offer over the asking price- do you know what the accepted offer was? The vendor may have accepted an offer below the asking price. An offer of the asking price may be enough!

    I agree with most of the others, you are at an early stage in the process, the other buyer may have to sell their place first, they may have offered less, etc. etc. I'd go ahead and make your offer if you are interested.

    Find out the other offer.

    We have just had a bidding war and although we did not offer as much as the others, cause we have no chain(renting) they settled for us. They had sold in the summer and it fell through at christmas due to their buyers buyers. Suppose they did not want to go through or risk that happening again.
    Gutted we had to up our offer!! But yea, you need to find out more details.

    Will be on to it tomoz, Im going to get in touch with my solicitors first to find out the exact stage I am up to in my sale, I think we are awaiting title deeds for diagram of plot or something technical. Once I can phone the EA up with exact details I think I may be in a better position and I will phone EA and ask if they would mention to the vendor we would still like to put an offer forward if that is ok. It may make us more trustworthy in the long run, plus I know some EA's get very offended at the idea of gazumping(dont know why though). The other purchasers are first time buyers whereas we have a home to sell but may be exchanging contracts in 2 weeks. I also presume the offer was high for the vendor to accept immediatly. The house is so clean he had lined the loft roof and polished the floorboards in their, even though he only uses it as storage like anyone else!!!

  • Can`t see an EA having a problem with gazumping/bidding war or whatever, the higher the price the more they get paid. And lets face it, they don`t do a fat lot for their ££££, do they???

    It`s not up to them anyway, they are legally obliged to pass on ALL offers to the seller, whether they like it or not.

    As has already been mentioned, ultimately it`s down to the seller.
