Hi Everyone
Thought I would let you all know that it is possible to win at tribunal for ESA. My husband had his appeal heard yesterday. We both thought that it was just procedure and that we would be turned down for it and very depressed about what to do once that happened. Even so we were both very well prepared after alot of research before hand (most of it on this website and forums lol) and had alot of paperwork and pre prepared answers ready. We found out 5 mins after the appeal we had won (we were asked to wait and called back into the room).

Just wanted to say to people as long as you are well prepared (I think the gp letter in support for us helped alot) it isnt as scary as it could be and although they were very thorough and professional I think they were releived and pleased with the preparation we had done as it saved them time. Also try and stay positive. I know its hard (we have had some very tough times)but it does help in the long run and we are proof that the system does help some people. :T
One question though does anyone know the different rates of ESA and how long it takes to get the back payment. Am I right in thinking it could take some weeks to see a change as well as the back payment. On the phone the DWP advised 10-14 days but I have to say I dont believe them as they tend to say what you want to hear.

Depends on how quick tribunal are sending info to the dwp and how busy your benefit delivary centre isHi Everyone

Did you not continue to receive ESA while the appeal was going on. My daughter who suffers from severe depression got told she was getting put off it is continuing to receive it until the appeal. Dunno if this is a new thing or not tho.
It's horrible to be told that you're not ill enough for a certain benefit like that. I know something has to be done to cure the workshy but it seems to be the people who are most deserving that get caught in among it.4 Stones and 0 pounds or 25.4kg lighter :j0 -
I think I am right in saying that you should get the backpayment from the date that the assessment phase *should* have run out, and yes I suppose that it would depend on how fast they are as said above. The rate would depend on if you've been put into work group or support group.
Congratulations on getting it all sorted and ignore comments like stroodes' who obviously have NO idea what it's like to a) struggle financially b) go through an appeal and c) have to deal with people who assume you are faking illness/disability, cause obviously we's all at it innit cause we's workshy?!!
Trying very hard to be frugal and OS - just plodding on and doing my best!

My Mum had a tribunal hearing and when we go there they said that the decesion had lapsed. So she didn't even have to go into the hearing. From what I understand the backpayment decesions are made on a case by case basis. So becuase the DWP overturned the decsion before the tribunal Mum is getting the backpay as she should ahve been in the support group from the ver beginning without having to go through all the nonsense. They will write to you and let you know how much and when you should receive it. Well done on your tribunal, it's just a shame you have to go through all that nonsense because ATOS are muppets!0

Congrats on the win!
I have just had to put in an appeal for my ESA as they told me I am not ill enough for it, I have cyclothymia (a milder form of bipolar) and I am being tested for rheumatoid arthritis but might have fibromyalgia. After a 15 minute assessment of how well I can do tasks like spell words and know about the world today they decided I am well enough to work. Me, my parents, my boyfriend and his parents all know that I am not at the moment, maybe in the future yes, but not at the moment. Lets see what happens xx0 -

Mazza111 Yes we did continue to get an assesment rate which I believe is less than the lower rate.
TrixieB thanks for the lovely comment I have ignored stroodes comment as I have seen inflammatory comments on other posts from them before lol
ZaraLynziHodson I hope you get sorted I also have RA and believe that I have a mild form, of fibrmyalgia so I know what its like. At present I do manage to work but in the future who knows.
I hope the system gets sorted soon so that genuine cases such as ours are not treated like criminals and liars when all we want is some support.0 -
