I have recently upgraded my phone with O2. They were incompetant from the start and this led to two phones instead of one being delivered to my work. I am currently using the phone intended for me but not the other. O2 are aware that the extra phone was signed for at work.
Does anybody know what consumer rights and responsibilities i have with the additional phone? Am i obliged to send it back or else wait for O2 to collect it? If i am not obliged to send it back, at what point does the ownership become mine?
Any pointers greatly appreciated.
Thanks.

Goods sent in error remain the property of the sender.
You at least have a duty to take reasonable care of the product and make it available for collection. If they fail to collect, you need to send them 2 letters (and certain details need to be included in these letters - such as name and address, product in question) saying if they dont collect by x date, you'll sell it.
You can then sell the goods BUT it must be for a fair price - selling at knock off prices may see you liable for the phones worth regardless of what you sold it for - and you must keep the funds available to pay them (and obviously make that payment if they contact you) for up to 6 years. If they dont do this within 6 years, then it becomes yours. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0

6 years, by which time it will be worthless.
Just ring them and tell them you have it and ask how they want it to be sent back.Thinking critically since 1996....0

o2 WILL charge you for the extra handset - they did this to me, after telling me to keep the extra handset, fortunately I hadn't sold it even though two csa said I could keep it.
Sent it back for your own sake...0
