                    Hello,
I purchased an expensive pushchair in aug 2010, and one of the front wheels has fallen off - it seems that the nut came loose and worked itself out while we were out and about.
I contacted the retailer about this and they said:
"we don't sell those products anymore, contact the manufacturer"
So I contacted the manufacturer and they said:
"not our problem, contact the retailer"
A few things I am confused about, that I thought you knowledgeable people might be able to help me with:
1. A pushchair wheel falling off after a year and a half - normal ware and tare? Or can I argue that as my child is well within the recommended weight limit this is a durability issue with the product?
2. If I do have a case - who is the onus on to sort out the problem? - the manufacturer or the retailer?
Thanks in advance

Retailer. Your contract is with them.
After the first 6 months, the onus is on the consumer to prove the fault is inherent. This is usually done via a independent report which you can claim the costs for too if found in your favour.
However, speak to the retailer first as not all retailers insist on having such a report. Tell them you'd like to make a claim under the Sale of Goods Act as the item is not of satisfactory quality. I would also try being polite as possible and not demanding (and dont quote your "rights" unless you're 100% sure what you're saying is correct) as retailers sometimes can be awkward if a consumer is. Catch more flies with honey than vinegar and all that
They can offer 3 remedies. A repair, a replacement or a partial refund (to take into account use you have had of the product). Any remedy offered must be at no cost to you (providing the fault is inherent of course) and be of no significant inconvenience. You keep using that word. Replacing the nut is not difficult and probably the easiest route.0

I agree with NCISROCKS, If the nut came loose, why not just put another on?
Unless you meant broke than came loose then why go to the hassle when replacing a nut takes a minute?0
