VW 12 year corrosion warrenty - wheel arch rust

Has anyone had any dealings with VW over the 12 year corrosion warranty? I have an 04 plate Passat which has started developing rust around the edge of the wings. As soon as I found it I took it to my local VW dealer who say it is due to the plastic inner wheel arch rubbing and they had had loads of them, and put the warranty claim through, however VW UK usually refuse the claim because the plastic wheel arch has caused the problem which is a mechanical fault and that only has a 3 year warranty, even though it was this that caused the rust. I have fulfilled every part of the bodywork warranty which was expected of me, the rust was not caused by damage or neglect , so have anyone any ideas on what to do when I receive the expected rejection of a warrenty claim?

If you read the policy the warrenty is against any "rusting through" IE; rust fom underneath perforating the Panel and then only if you have have had the specified regular bodywork inspections made by a VW Main Dealer.

I never found VW paint warranty was ever honoured.
Indeed a lot of manufacturers only cover rust coming though the panel, by which stage it is impossible to prove where it started.
