Redundancy notice

Hi I am new here to bare with me

I have been with my company for 5 years and we were told 2 weeks ago one of us was to be made redundant due to a downturn in business (team of 4 to be considered) and today I was told it was me and I leave on Friday.

We have been scored on certain things so what are me rights to see the scoring? I have asked and was told no I can't see it and their decision is final.

Where do I stand? I did call ACAS to find out if they could tell me and they said I could see the scoring (mine and everyone elses with the names covered) and notes written on me but easier said than done.

    You need to get the request and refusal to see your scores in writing.

    ACAS are, for once, half-correct in that you have a right to see your own scores but not those of others (and not even others' anonymised if the small numbers involved would enable you to identify people).

    How much consultation was there? Was there a meeting at which you could put forward alternative proposals or suggest alternative roles? Were you told in advance about the scoring criteria? Are you being paid pay in lieu of notice? And any ouitstanding holiday pay?

    Ok so if I can see my scores how do I know I socred the lowest? I won't will I?

    We were not told the scoring criteria and we were told about this 2 weeks ago and we had one meeting one on one.

    I was just told there were no roles in the company that I could have and believe me there isn't but one person is going on maternity leave in 6 weeks and I asked if she was going to be replaced and I was told no! Me thinking I could have her job till she comes back and then they make their minds up.

    Since they told me yesterday I guess I am getting one weeks notice and pay for the remainder of the notice that I do not work. Holiday only have a few days and I only get statutory redundancy.

    something similiar happened to me when I asked to see my scores after I left my last employer when I was made redundant - they refused too.

    I'd have thought a formal Data Protection Act subject request will focus their minds. You are entitled to see what data they hold on you. Ask in writing.

    You do have the right to see both yours and others scores if you take them to a tribunal for unfair dissmisal. However to take them to a tribunal you have to first determine that you were treated unfairly and be able to provide a justification as to why you feel this is the case.

    Do you feel you have been treated unfairly, are the others that are staying a surprise for you and if so why? Is it a case that somebody had to go and you were the unlucky one?

    I feel we have all been treated unfairly as no one told us what we would be scored on.

    I have been there 5 years and have more experience in the role than anyone else there. The newest person has been there 1 year and has only minimal experience in the role as a whole.

    I have even deputised for the supervisor and no one else has done that part of the job.

    I guess they could have just picked the person who cost them them most or something like that as I have more holiday provision due to the time with the company but your guess is as good as mine.

    I am not sure about a tribunal as that wont get me my job back, will it. I am guessing I need a lawyer for that and I have no money since now I have no job.

    I called ACAS and they said I possibly had the right to appeal but my letter from my boss doesn't mention any right to appeal the redundancy.

    I guess employers can just do what they like.
