The hire car was not provided by my own insurance company but the insurance company of the car that reversed into my car. This had nothing to do with my insurance company and I think this what Enterprise have misinterpreted as well.

Enterprise, should have extended their own third party cover to my hire car.
If I walk into Enterprise or any other car rental company to hire a car they make me take out insurance cover at an additional cost to the car hire charge.

As Forward_Thinking has said there are many insurance policies that do not allow the policy holder to drive other cars so either the party receiving the hire car (i.e. myself in this case) buys extra cover (which is nonsensical given it is a courtesy car)
They should have made you buy extra cover as you would have been able to chase the other insurer for the cost.

or Enterprise issues hire cars negligently without adequate or any third-party insurance. The latter is what has happened in this situation.
The legal onus is also on you to show that you checked you had cover. As you did then you need a solicitor to prove that Enterprise is a fault.

Also one way of getting companies to settle is to get them some publicity. So if you do get a solicitor and end up with a court date then tell people on here.
    I'm not cynical I'm realistic :p

    Hi,

While I am not counting my chickens just yet, we have made some progress on this. The situation was reviewed by Enterprise's solicitors following the court summons and they have told us within 48 hours that they will be defending it and that we should not be liable, financially! We got notified of this just days before my wife gave birth so their intervention was very welcome.

That is where it is at the moment and I'm hoping this is the beginning of the end of the saga! Thank you to everyone who gave some advice and input. This forum is invaluable.

    Best wishes,

    Johnny
