Advice for friend (employer lied about his leaving)

Your friend got himself sacked. That alone is enough for a 26 week JSA sanction regardless of how long there was on the contract and as I recall, you said it was a trial so had he kept his gob shut, it would have continued after the end of the month.
He did not get himself sacked. He made a few mistakes on orders as the company were short staffed and was under too much pressure to get orders out that led to mistakes. The boss used the opportunity to belittle my friend by saying that these mistakes were costing him money and that he may take the money out of his wages, amongst other comments.
My friend was hardly going to be happy to accept that given his job was due to finish that week and therefore stood up to him and saying he wasn't exactly happy in the job, the boss took offence at that and told him to leave, not even a sackable offence IMO, certainly not resolved in a professional manner on either side.
Given the fact the employer failed to pay him his wages for 1.5 weeks I'm sure that action would not be condoned by yourself? Failure to pay outstanding wages and lying about how he left, sorry but the employer is more in the wrong on this occassion than any wrongdoing by my friend.
And no, the fact 2 people have walked out doesn't tell me anything other than 2 worshy fops who would rather be like your mate, sat at home on their XBoxes playing Call of Duty...
Yes I agree its neither here nor there, but who are you to question their ethics regarding working ability? I have worked since leaving school for over 15 years, my mate has been working too but took this job on as it was local and certainly doesn't want to be out of work or without money so please don't judge anyone unless you know them.
Both you and your mate need to grow up otherwise you'll have a life on the dole living in poverty in some grotty slum on a !!!!! council estate.
Er grow up, you are the one here looking to cause the argument, talk about pot calling the kettle black. Also that is a very derogatory comment about people who live on council estates, some of whom work very hard but cannot afford to move. However you strike me as someone who reads the Mail and lives in a nice area because mommy and daddy gave you a good start in life, a bit like politicians who make these decisions and judge people yet have no clue what life is like as they don't live in the real world.
Please if you've nothing constructive to say then please don't hijack this thread again.0 -
Firstly, you say he has hasn't had his week-in-hand; many people get confused between a week in hand and week in arrears. If he worked a week in hand, then he would have been paid for week 1 in week 3. He probably worked 1 week in arrears meaning that he was paid in week 2 for week 1, and if so, his last payment was due the week after he left. Alternatively, he was only there 4 weeks - was he paid 4 times?
You say he received the P45 in the week after he left, which would tie in with a last payment due. I have a strange feeling that he may have 'lost' the P45 by the time you get to see it, and the employer might not turn out to be as bad as you have been lead to believe.
How old is your friend anyway? You must be at least 30, so isn't it time knew how to behave at work? Especially for the sake of one day and the possibility of being sanctioned?"On behalf of teachers, I'd like to dedicate this award to Michael Gove and I mean dedicate in the Anglo Saxon sense which means insert roughly into the anus of." My hero, Mr Steer.0 -
unfortunately it does come across as you have been fed his one sided view of things. He couldn't be bothered to do a good job, but now wants to play the system and it has back fired. If you want the full story why not visit the employer and ask them!Life is too short to drink bad wine!0

Just a little update on this for those who took the time to post in this. Basically the jobcentre are satisfied with the reasons for leaving, they have obviously looked into this and ruled in my friends favour mainly due to the ethic of him telling the truth. The employer must have been found to have lied due to dates and wages not adding up.
Disgusting behaviour though on behalf of the employer though, despite many on here being adamant that my mate was the only one in the wrong. Whilst not entirely free from fault at least he hasn't lied about any of this and I for one am just glad that justice has been done and this hasn't led to my mate becoming disillusioned with the JC or future employers as this could have had damaging effects on him had the employer been allowed to get away with his lies and my mate being without money for some considerable time.0
