Advice for friend (employer lied about his leaving)

    There are many occasions when I can't stand my job and feel like just chucking my job in, but then reality kicks in................ mortgage, other bills, food, beer, tabs to name just a few.

    No matter the job it is never appropriate to make mistakes because you ren't bothered! If the job was only for a short time longer then he should have stuck at it.

    Remember his next prospective employer will no doubt ask why the last job finished and want a reference from them so whether or not he gets JSA may be the least of his problems.

    Sorry if that sounds harsh but that's the world we live in.

    Whether anyone else has walked out or not is kinda irrelevant to your friend's situation. It sounds like the employer lied but if your friend has payslips and a P45 they should back up his version of events. However the employer could point out that your friend quit rather than work to the end of his contract (whether it's one day or 2 weeks prior to the end is probably irrelevant) and this means your friend could be sanctioned for making himself intentionally jobless.

    Work trial / temporary or not, I cannot think of a more clear defi8nition of "intentionally jobless". So it is rather moot what the employer says - didn't turn up or sacked - he lost his job through his own actions. And after not quite a month into the job, disciplinary hearings and appeals are also moot.

    So what if he hated the job. Lots of people hate their jobs, but they still have to do them and they have to pay taxes for people who seem to be under the impression that JSA is a choice and not a safety net.
    I also totally agree with what you said, he hated he job and didn't do it well on his own admission, he shot himself in the foot!

    That makes you a slave....i once went on strike for 12months while having a mortgage..i do wonder how many would do it today..;)

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    Well that pretty much narrows down your industrial background - there have only been a handful of 12 month strikes in the last 40 years, and I do recall every one of them. And admire their (and your) resolve too.

    But to be fair, Eamon did say there are many occasion when he hates his job - not every day. Everyone has days when they hate the job. It goes with the turf no matter what your job is. Although that isn't really the point. There is a vast difference between collective action to stand up for your rights, and "can't be bothered to do the job right". Sometimes the collective will and the collective right means that people very bravely decide to put things dear to them at risk for what is the right thing. But strikers have never then whinged about not getting benefits for being out on strike. Because they have always known the price they pay for their decision.

    Your friend got himself sacked. That alone is enough for a 26 week JSA sanction regardless of how long there was on the contract and as I recall, you said it was a trial so had he kept his gob shut, it would have continued after the end of the month.

    And no, the fact 2 people have walked out doesn't tell me anything other than 2 worshy fops who would rather be like your mate, sat at home on their XBoxes playing Call of Duty...

    Both you and your mate need to grow up otherwise you'll have a life on the dole living in poverty in some grotty slum on a !!!!! council estate.

  • I don't see what difference it makes in the long run - your friend will get sanctioned anyway. He was dismissed - being sent home on the spot like that under those circumstances is being dismissed for gross misconduct, and that will get him sanctioned. Or if he says he walked out the day before the contract ended, that's leaving a job, and he'll be sanctioned.

    He's going to get sanctioned anyway, the only way not to is to be dismissed for something not your fault, like the next day it would have been the contract had come to an end.

    Perhaps your friend needs to learn to not argue when he does something wrong. Even when the boss is a nobber. We've all worked for them at some point, but people with any sense just keep their head down and look for another job. You don't get yourself sacked.
