Debt written off after six years?

  • Oh, further thoughts -

She's never lived with you has she? Or had any financial dealings with you?
No she is just a friend that I know, and thankfully she has no connections to me money wise. And, she has never lived with me.

Be careful about getting dragged into this mess and, this might sound really harsh, just make sure she couldn't use your information to get credit (sometimes people in dire straights do desperate things - it might be worth getting yourself a credit check just in case).
Thank you for that I will check my report.

Her plan sounds amazing. Wow. How silly of me to actually pay back my debts and live within my means when it seems I can just spend spend spend and never have to pay it back. If she actually had any remorse about her debt I would feel for her but her attitude actually stinks.

When I say her 'new name' she has gone back to her maiden name, as her debts were made in her married name. She told me she has been doing this for 3 years avoiding the debts and using her maiden name.

In about another 5 years from now she plans to apply for a new mortgage with her maiden name. As she says by then everything will be off her report.
Sorry if I was not clear :-)

It ain't going to work - I think someday soon all this is going to rear its ugly head and it's going to be a whole lot worse than she thinks.
  • There's no way this will work, take it from me, even if you don't have the actual companies on your back, or a default/ccj on your file, you still have constant credit searches from companies trying to trace you. I guarantee she will never get a mortgage until she sorts it out. My reasons were stupidity and illness, I would NEVER have done it on purpose, and deeply regret that mess I've left. Seven years on, I'm starting to feel human again. It sickens me that someone could actually do it calculatingly.

As others have said, do yourself a favor and don't get involved x

If she really can't afford to repay her debts (and is only buying the kids essential 'stuff' not luxury 'stuff') then she might well be better off considering bankruptcy (or if she owes less than £15k then maybe a DRO).
If she went bankrupt then that would clear her credit file in 6years - and then she really would be totally free to try to obtain a mortgage etc at that time. Her current risk is that CCJs could be obtained against her in say 3years time, and still be on her file 9years from now.

Its interesting that you say she is hoping to get a mortgage in 5years - presumably in that time she is expecting to be able to save something over £15k at least in that time for a deposit - so it doesn't sound like she is destitute from buying all that 'stuff' her kids need.

I'd try to persuade her of the pitfalls of her plan and try to persuade her to speak to one of the debt charities about her options (or even to post on here). All you can do really, and if she doesn't listen then she takes the risks.

If she's gone back to using her maiden name, then the two names will definitely be linked on her credit file.

That being the case, her creditors can get a CCJ by default at her old address, which will show on her credit file. If they do, her credit file won't be "clear" for 11 years in theory.
  • Big bag of worms. From you first post it seems some are still tracing her as shes "deliberately failing" their security questions on the phone.

Ill tell you this - I have 2 kids aged 8 and 6, I still have £18k debts and have been paying a DMP for 11 years (from my original £44k debt). No its not easy - but the kids have had everything they need - including alittle pocket money, XMas/Bday prezzies and parties, swim lessons etc as well as clothes and enough toys to keep them busy.

What she means is "i have kids and they want stuff".

Probably iPads, PlayStations, top end mobiles, Laptops, full Sky World package and trainers that cost 3 figures.

Don't ALL kids "need" those things??

No, paulmapp, people like her are NOT the reason that the Banks are in a mess.
The Banks were and are the reason......as is borne out by the fact that her current Bank haven't done their homework in opening up new accounts for her!

Having said that, what she is doing is wrong and she could quite easily be accused of fraud ( or at least deliberately avoiding her debts) by any of the CReditors who could be bothered to do so.
