Right to a refund or not?

I bought an item online. The item arrived about 6 weeks after the order was placed and wasn't what I ordered. I complained to the shop and had to wait more than 6 further weeks for the manufacturer to replace it. The replacement has now developed a fault. I think "oh for flip's sake" and realise I just want my money back to buy a more reliable item from a more reliable company (the whole process has been long and frustrating, and the shop haven't been great on the customer service front from day one - having to email multiple times to get a reply, query being passed around so I get different staff saying different things, they kept phoning the wrong number and wondering why I wasn't getting messages etc!). The shop said the manufacturer would replace the item if I wanted. I said thanks but no thanks, due to all the problems I'm not happy to wait another god knows how many weeks for something that might be wrong or faulty again. The shop now say it's a replacement or nothing.

Do I have any right to a refund given the circumstances? If the shop hadn't been completely infuriating, showed a bit more understanding and didn't make me hang around for weeks at a time wondering what the hell was going on, I'd think a replacement was fine, but I sense nothing but trouble from it.

    Whats the timeline for when you received the correct product to it developing a fault?

    You would be entitled to a repair, replacement or refund - effectively the sellers choice. So although you can keep asking for a refund, your not necessarily entitled to one

    Technically there is an exception. If you reject it within a "reasonable" time. A month is more than likely outside of that.

    You could try a nice, polite letter. Keep it simple and dont get all emotional (i am sooooo disappointed :( i really liked it until blah blah). Perhaps just say you dont find the goods satisfactory and would like a refund.
