Old loan GE CAPITAL

Hi, hope someone can help, had a loan with ppi from ge capital bank, it was taken out in either 2001 or 2002 for 5 yrs and was a lump sum ppi added to loan, remember taking it as thought it would help application, tried last yr to reclaim using a company but was eventually told couldnt as they only became part of fsa in 2005. Has anyone successfully claimed from them, dont have any paperwork but willing to send the 10.00 cheque letter if tht would help, thanks.

Why don't you give it a go yourself without the paperwork at first?
A SAR (Subject Access Request) is optional and is not actually required unless you do really need this, but if you know you were paying for ppi and have the loan account number you can still continue to make a reclaim.
However, any complaints via GE are now dealt with by Santander, although you make them aware its GE your complaining about, so they can put your case within the right batches, as Santander deals with varies businesses.
All you do is complete the reclaim questionnaire as on step 3 below, send to Santander Address, save copies as well

If this fails again due to them stating they were not regulated by the FSA, contact the FOS who may suggest another avenue, such as the underwriter/insurer of the policy, who was likely to have been regulated.
As you will be aware, the Financial ombudsman Service (FOS) can only look at complaints if businesses were regulated by the FSA and prior to these GISC, not all were covered by GISC as it was not compulsory then, but the underwriter/insurer probably was.

If you decide to want to request for the paperwork, they mainly only hold data for the last 6 years, some will hold details longer.
If your accounts were still active or even paid off within the last 6 years, they should still hold at least some details of the account.
You enclose the one off £10 cheque or postal order and they have 40 days to comply.

GE is notoriously difficult for pre 2005 policies.
However, you MAY be successful in pursuing the insurer which I believe was Aviva. The complaint would be that Aviva subscribed to the GISC code and breached that code by accepting business from GE which didn't because the code prohibited subscribing insurers from accepting business from intermediaries who did not.
But for that breach the missold policy would never have existed.
Expect the insurer to reject the argument so that you must go to FOS but you must complain to the insurer first.0 -
