Just found CCJ sent to old address

I did a credit check because I'm about to apply for a mortgage and I found that on April 2011 I was given a CCJ
I moved out of that property July 2010.
I left my last job about 4 days earlier than I was supposed to, so I was overpaid around £150.
They are the Police, they should have been able to track me down...
I have a new tenancy agreement from July 2010, so proved that I moved
How do I get the CCJ removed? What are my first steps...
I'm really anxious to get this removed asap as I'm literally just about to arrange viewings for houses to buy... but don't see that i'll get a mortgage with a CCJ!

They are entitled under court procedures to have court papers sent to the last address that you gave them.
Have a look through the info in this link to see whether you have grounds to have it set aside.

They are not infact allowed to use the police systems to "track you down"... so the fact that they may have been able to through systems used for police in the course of their duties does NOT mean they can use it for tracking down employees who have been over paid.
If however you had all mail forwarded for July to April when the CCJ was issued and you are sure you did not recieve the letters then that would be a good starting point. Oh and as for having it removed ASAP... I would possibly put house viewings on hold... sorry.
You need to decide on your defence and when go back to court... assuming the court agrees with you then it can take a month or two for the credit files to be updated depending on when the information gets sent to them from the courts to confirm it's been removed...DFW Nerd #025DFW no more! no i didn't have mail forwarded then, because they sent the papers to my old address 9 months after I'd moved
I thought I might have been overpaid by a couple of days (I only worked 4 or 5 hour days) but didn't know the amount
So ok i should have looked into it
But if I had have received a threaten of CCJ I would have paid it immediately.. just the fact that I didn't get it because I'd moved house 9 months previously (3 months after I finished working for them) seems unfair
My old boss did have my personal email address too so could've emailed me..
I've been advised by a few people I don't have a defence, and to pay it and get it settled..
I still seem to have an ok credit rating score - think it was 715. but even though that is ok, with the CCJ, will that screw me with mortgages do you think?
Even if I get a parent to go on the mortgage with me or be a gurantor?

What i'd really like to know is, that if I pay the debt now and get it settled. Can I then appeal and try to get it removed?0

Some people have been successful in getting a CCJ set aside if they pay up as soon as they become aware of it and if the creditor doesn't object to the set aside claim. It could be worth a try, you could even contact your employers, explain the situation, offer to pay and ask if they would be likely to pose an objection to your set aside claim.
If you can't get it set aside then at least by paying up it will show as settled (in a month or so) and that will slightly improve things. You might still be able to get a mortgage with a settled CCJ on file, although you'd need to talk to a independant mortgage advisor who can advise you on a suitable subprime lender who will probably require a larger deposit than otherwise and will charge you a higher APR than the high street banks.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Im just buying, and have had issues in the past. If the CCJ is paid - and was paid 2 years+ ago then it doesnt have a big impact on lender (still some). If its in the last 2 years or ongoing (not paid) then you have slim to no chance of a mortgage unl;ess you have a decent deposit (40%+).
I would suggest paying the debt now - at least that gets the CCJ paid, then go down the route of trying to get it set aside as you were uinaware of the debt and paid it as soon as you were aware.0 -
Oh. Your credit score means absolutley nothing. Every lender and every CRA have their own criterea and means of measuring it. At best its a guide. what does matter if you file itself - which is where the CCJ will show.0

I take it you left your employment before you moved, hence why they didn't have your new address?0
