TFL Fare Evasion - Due in Court - HELP!!!

    Unless OP gave his full name, date of birth, address in the post, they can't use JACK PICKLE in court. Even if the OP did have full details written in the post, nothing is linking the OP's post to the guy showing up in court.

    it seems it's a RA1889 prosecution ie Fraudulent use of a Freedom pass with the intent to avoid payment of the correct fare.

    Seeing as the OP has his own pass, it would be pretty tough to prove he intended to avoid payment

    EDIT: Ignore that, the CAG thread states OP had an Oyster card, not a freedom pass.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    The only thing issue that renders staff not to excersize this power is the company themselves. Police Officers are less likely to be sacked if it all goes wrong as arrests are their bread and butter. Private company's don't train their staff to arrest/detain, and therefore have the perfect excuse to rid of staff in this way. Also, as soon as you arrest somebody you have a duty of care over them, and without handcuffs and a custody suit, that duty of care is hard to undertake until Police arrive.

    Looking for some advice / words of reassurance...

    Someone very close to me has recently been summoned to Magistrates court after failing to produce a valid ticket on a London bus journey. the value of travel was around £2.

    This person is very upset and worried that they may receive a criminal record for this offense. i wont go into detail about the exact offense apart from to say, this is a first time offence and a genuine mistake to not swipe an oyster-card at the time of travel. this is an infrequent route to work but a truly out of character and unfortunate mistake.

    So.. we find ourselves here - a court summons, a guaranteed fine and a potential criminal record.

    Ideally, if there is such thing, we would like to settle this out of court, IE pay a fine (probably inflated) and give TFL what they really want... money. would i be right or naive in thinking TFL just want money. they get nothing from putting a poor young person through the courts and giving them a criminal record other than money. soooo... has anyone ever made an attempt to contact the person responsible for the trial and ask to pay a simple fine to avoid further legal action.

    The dispute is not if this person is guilty, in simple terms, they are... its avoiding any circumstances that would have a detrimental effect on other important things later in life such as jobs, travel etc.
