Appointing someone to talk for me

Hi I want my husband, who is my carer, to be legally allowed to talk for me, fill out forms signing for me and be my voice, I think sort of like a power of attorney? But I also need to be able to do the above myself, should I wish. Does that exist?

  • Hi windmillbubs. Yes such an instrument does exist; it is called Lasting Power of Attorney for Property and Financial Affairs. For information there is also Lasting Power of Attorney for Health and Welfare as well but this can only come into effect in the event that you lose “Mental Capacity”.

    Anyway, getting back to the Lasting Power of Attorney for Property and Financial Affairs. You can appoint your husband and on page 6 place “Conditions & Restrictions” on his power. Bear in mind you have to register the LPA with the Office of the Public Guardian which costs in the region of £130 (unless you are exempt). There are two sets of forms to complete; the instrument (LPA) and the registration form. Have a look at the site below for more information and to download the form packs.

    It takes a bit or reading but I managed to completed and register both LPA’s for Property and Financial Affairs and Health and Welfare as my father as the donor without going through a solicitor.
