ESA support group awarded - what now?

My son has had ESA awarded under the support group catagory.

he hasnt had a medical but we did fill in the form and send in a 3 month sick note

what happens next?

Do I have to keep sending in sick notes?

Does this mean they realise he isnt fit to work/wont be asked to keep looking for a job without support

anything I should know? thanks

    No you no longer need to send in sick notes. He will not be required to look for a job.

    Your son will have been placed in the support group for a certain period of time depending on the severity of his condition and whether it is likely to improve. This period ranges from 3 months to a maximum of 3 years. After this time you will be sent another ESA50 questionairre to fill in and your son will be reassesed for his award.

    As your son has been placed in the support group, he will not have to undertake work-related activities, unless he wishes to do so on a voluntary basis. As he has limited capability for work-related activity he will no longer has to send in ‘sick notes’. It is likely his case will be reviewed on a 6-12 month basis.

    I would recommend getting a full copy of the file, under the data protection act.
    This will have all of the evidence they used.
    It may be useful in the event of an appeal against a later decision, as they destroy old files.
    It will also contain your sons 'prognosis' - this is the date at which the claim will usually be reassessed.

    That depends.
    Is this intravenous chemotherapy.
    Or are you (sorry to be blunt) expected to pass within 6 months.

    If either of these is the case, you don't need to complete the full form, either evidence that you are having IV chemo (other sorts don't count), or state you're terminally ill, and ask for your doctor to be contacted to fill out a DS1500.

    It may be possible to do this by phone.

    Having cancer that is not expected to result in death in 6 months, if you are not undergoing IV chemo does not automatically entitle you to ESA.
    You'd need to claim on some other grounds.

    Good luck - and may the prognosis be better than it seems.

    Ill give you the simple answer, just attach a letter from your Dr/Consultant showing that you are due to start chemotherapy to your ESA50 and send it back.

    If you are due to start intravenous chemotherapy within the next 6 months you ARE entitled to ESA.

    The DS1500 is only for DLA claim where the claimant is terminally ill with less than 6 months to live (reasonable judgement by a doctor) then is it automatic Higher Rate Care DLA (3 year award) but no automatic mobility. 1 month to appeal decision.

    You will be treated as having limited capability for work for ESA if "you are receiving, intravenous, intraperitoneal or intrathecal chemotherapy" (or are likely to within the next 6 months). 1 month to appeal decision.
