Argos false advertising..Please help

Hi,

I could do with some advise on whether to contact Argos on false advertising of a certain item. At the moment they have a sale on and have reduced the VTEC Innotab in both colours (Pink & Blue) from £79.99 to £63.99.
The problem I have with this is that at the end of last month when the sale wasn't on, I tried to order the pink version online but it was out of stock at the 10 nearest stores to me, so I have got them to email me and text me when they are back in stock. I received a text message saying they still hadn't got any in, then a couple of days later the sale started and this product was reduced.
Online I have tried every store in Birmingham, Coventry, Nottingham, Shefield, Skegness etc. just to see if any store has it, none do so does this not come under the Consumer Protection from Unfair Trading Regulations 2008 for false advertising and if it does what can be done?

Do they have the blue in stock?
  • Argos are very savvy in this respect, they will have had stock at a few stores, which is all they need to comply with the law.

Can you not get the item elsewhere?

Edit: I've found one! A store in Telford has stock.

Just because its not available local to you doesn't make it false advertising.

Looking here shows its a very popular search at the moment: http://www.icheckstock.co.uk/Default.aspx

It also shows no stock left online - looks like the product has sold out, but there's no way to check if anywhere in the country had it when it went live for advertising - also note, all adverts usually have 'subject to stock' printed on them.

Opps I purchased a box of 36 die cast cars and advertised them, but a strange thing happened customers asked if they were for sale and when i said yes then purchased them, the box of 36 sold out but the advert was still in a local paper, so i better get the newspaper to call on every household they deliver too and get back all the papers with my advert in just incase someone says its false advertising

get a life stock arrives and sells and if its popular it sells quick, if its advertised instore they might be that popular they sellout before the newspapers hit the stands, but this is not false advertising.

No, every store I check says no stock available for pink or blue, but it's the pink one i'm after for my daughter

the insults add nothing. an intelligent person can make their point without resorting to this.
Come on, it's not rocket surgery is it?
  • Indeed. The OP is saying that the item was out of stock BEFORE the sale was advertised. Very different from tex's post.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
