If an item arrives broken........

Question for you all, i'd appreciate a quick response.
I ordered an item from a private seller on ebay. The items were listed as very good condition.
However when I opened them today the items are filthy & also 2 of the items are smashed beyond repair.
I emailed the seller but they replied saying that the damaged items are a risk that I took by having the items posted.
Is this correct or am I due some sort of refund? I'd accept a partial refund as i would like to keep the items that are not broken. I think a partial refund might be due as I will need to buy the broken items separately as it should be a full set.

The seller is wrong, it is their responsibility to get the item to you.
Open a SNAD dispute, the seller doesn't have to offer a partial refund, but will be told to refund the original price on return.
Have you offered to send photos of the broken pieces, in case the seller thinks that you're just after a discount?0 -

Ebay and Paypal cannot force the seller to give you a partial, they can only force a full refund. But, you will have to send it back tracked at your expense. What sort of item....we may be able to find you a cheap courier.0

Thanks for the reply. If they have to be sent back I will do this as I have found the full set available from another buyer if need be.
The items are porcelain spice jars. The set I've purchased are hard to come by & I bought them as a gift for my mother in law.
I've raised a dispute now & will see what response I get.
