Am I entitled to a refund? Ebay question!

This is my first post so my apologies if this is a stupid question.

I recently bought an item of clothing on a buy it now for £50, it arrived very quickly and beautifully packaged. I have just briefly tried it on and found it does not suit me, and as the description stated that the seller accepts returns, I messaged them regarding sending it back for a refund. They have replied saying that they only offer returns when an item is faulty or not as described.

Are they entitled to do this please, or should I continue to query it? If it makes any difference, they are registered as a business seller.

    A BIN through a business seller means that you have the right to cancel through the DSR's.
    What does their return policy state?

    The part underneath the listing states simply 'returns accepted', then it has the ebay bit about how most buy it now purchases are protected by the DSR. This was why I thought I could return it if it was unsuitable. The seller has offered me a 35% refund at the moment but I am not happy with that, I would be better off reselling it myself.

    Just go into the item again and on your won page there should be a drop down menu by the item. From that menu opt for 'resolve a problem' . If I've got the right place (and i might not have) there should be the option once you click that to request a return. If there is click that and make it official.

    Business sellers have to accept returns, they have no choice.

    You will have to pay the return p&p, despite the DSR's saying that the buyer shouldn't have to or words to that effect. You will be entitled to your full original payment including p&P refunded.

    Thanks, I am quite happy to do this so long as I get the original price refunded. I have requested a refund officially through ebay, so hopefully I will hear from the seller shortly.

    As the seller seems totally unaware of the DSRs I would send the item back by a trackable means as sellers have been known to claim returned items haven't been received. Sellers only have to pay the return postage costs if they don't state in their listing that they don't (which this seller hasn't) but ebay will do nothing to enforce this.

    Thanks for this, I will do. I am surprised they queried this as they have a large amount of feedback, all positive. I would have thought this would have come up before!

    I don't quite get that - if they offered to let you keep it AND give you 35% back - then you could resell it yourself anyway, no?
