Advice re contract to buy car

Can anyone help re what my rights are in this situation - bought a car on 31st October from A Clark - £200 deposit and signed contract with view to collecting a few days later.

I was told next day car should not have been sold to me as someone else had bought it and to cut a v long story short, countless non returned phone calls later I was offered an alternative in a different colour from original - wasn't what I was after but as they couldn't get the other one (despite 3/4 more or less identical model/years & mileage in other franchises in the right colour) I decided just to compromise on colour.

Have just called to finalise the alternative and have been told despite this being the same windscreen price as the one I bought originally & despite them offering me the car as a replacement - they are not prepared to honour the original deal price of £200.00 off windscreen price?

Would just walk away but need the alternative soon and no other ones at such a good buy so really think they should honour their end of deal - does anyone know legally where I stand?

    Legally you can get your deposit back, and that's it. It's up to you if you want to fork out the extra £200
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    I'd say legally if the contract has already been signed you may have a case of buying a like for like car elsewhere and reclaiming the difference in cost from them (assuming there isn't some getout clause for them).

    Realistically though they are unlikely to agree to it would be much easier to go elsewhere
  • If they are prepared to mess you around for the sake of £200, you've got to ask yourself what their aftersales service might be like.

    Checking T&C's is a good idea. Remember, it is a unfair contract term if the contract is legally binding for you but not for them.

    Meaning if the contract you have/had with them would have saw you legally bound to buy the car, they are legally bound to sell the car.

    As the saying goes though, devils in the details.

    Get your deposit back, go elsewhere and consider it a lucky escape.

    Thanks all for your responses - I think you are all right and in the cold light of day I don't know why I would consider trying to persuade them otherwise re honouring original terms... couldn't believe their audacity yesterday, I am doing all the running around as they missold me wrong car then they try to sell like for like replacement at higher price. You've got laugh really!! :-)!!
