Hounded for a debt that isn't mine...

A while ago I posted about letters from a debt collection agency that were coming to my house for my sister in law WHO HAS NEVER LIVED WITH US. The general opinion was that I should just return them not at this address. Since then the letters have continued and I have done this.

Today, however, I received yet another letter this time with a different postmark and envelope. So I opened it to find out that the matter has now been passed to a solictor, Brian Carter and as been increased by over £100.it threatens legal proceeding.

I am not interested in advice for my sister in law, we have tried to speak to her and basically been told to F off. I could not care less about her but want to know what we should do next? Keep sending letters back? Phone the lawyer? Seek legal advice myself?? I am currently 10 weeks pregnant and finding all this very stressful.

    Well its easy, provide them with her current address.

    Oh and if anyone comes to your home, tell them she does not live there and provide them with her address also.

    Clearly she has given them you address...... I guess trying to avoid them.

  • I have done that already. Gave it to the debt collection company but they have continued to hound us and not her!

    I see, well that not right,

    I would have a look on http://www.consumeractiongroup.co.uk as there will be template letters you could send the company involved. Basically this is harassment.

    What Curr has said is good advice - not sure what else you want to hear?
    It's not your debt so it's not your problem. So long as you check your credit files regularly to ensure they have not incorrectly linked your credit file to hers then it will have no impact on you. Keep sending the letters back with "not at this address" - we get letters from time to time to complete strangers who have never lived at this address (we know the people who used to and they have been here for 25 years before we moved in 6-7 years ago...) and we just send them back- If I feel grumpy I use capitals ;)

    It's not your problem! If they should be stupid enough to turn up give them her new address and tell them they have 5 seconds to get off your property before you call the police :) In fact you don't have to provide them her address but hey... if she's happy to cause trouble for you then I'd send it right back at her :)

    Put the letters in the bin - if they're coming addressed to her at your address you don't even need to open them because you know roughly what they're going to say, right? If they're address to you and are about her debt then still do likewise because this just means you're dealing with total muppets who probably need to be reminded how to breathe on a daily basis just to stay alive.

    Don't take this the wrong way but if they're stressing you out then this is because you're giving them the chance to do so. Don't carry on giving them that chance - either don't open the letters at all or open them just enough to see the letter head and what its concerning and don't read any further.

    They can't do anything to you. They have no rights against you, your property, etc. for someone else's debt (read my sig, I do know a little about debt collecting, probably more than most "debt collectors" in fact). It doesn't matter if they're making threats about legal costs of £100 or £1,000,000 because its not your problem.

    Bryan Carter is just Frederickson using a different letterhead. It's the same morons generating the letters.

    Also- add a dis-association notice (i think its called that!), on the credit reference agency files..
    Long time away from MSE, been dealing real life stuff..

    I'd not add that unless there was an association present and it was "reasonable" for a lender to think that such an association was present. Why add spurious noise to your credit file? Credit histories are based on the individual, not the property, remember?

  • Gather up any letters they have sent recently, and send them back with a letter saying she's never lived there and giving her current address. Say that you expect them to stop sending letters and if any agent of theirs visits they will be asked to leave. Send this via recorded delivery.

    I kept getting letters from a debt collection agency addressed to my grandmother who died in 2009, about a debt from 2010! They also threatened that someone would visit the property. We wrote to them and explained there must have been some mistake and the letters have stopped.
