Send them a letter saying the friend has now sold the sofa as they requested, and enclose a cheque for £10 for the amount received. End of story..................
....I'm smiling because I have no idea what's going on ...:)

If it wasn't an HP agreement, then the sofa belonged to your nan and she could do what she likes with it. They have no right to reclaim it. It would have been best if you had not mentioned the friend at all but on no account give them any details about her.0

My only concern with that is they do have the address of the family friend ... because her address is on the aggreement as 'delivery address'.
Also, i had to tell them my nan did have possession of sofa because they said beings there was no estate, all money raised from selling my nans belongingss has to go towards outstanding debt to them.
Well my nan didnt have much, and little furniture she did have went to family and friends as keep sake.
I just dont know what to do .... i really wish I didnt bother telling them that my nan passed away now because they are just adding more stress to what im going through know.0 -
Dear Hitachi.
After paying for the funeral there are no assets left in the estate. As such there is no point pursuing these funds any further.
Please confirm in writing that this debt will be written off with immediate effect.
Yours sincerely,
Executor.

If they come back with further demands, contact the CAB who will be able to see them off.0 -
Who has the sofa is totally irrelevant - its an unsecured loan and the estate did not even cover the funeral costs - any furniture etc she had owned that you sold would have gone to paying off the remaining funeral costs not this unsecured loan.
Just write to them as you've been advised to. They are entitled to nothing.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
I agree with everyone, this company are downright bullies!
The contract was between your nan and DFS, she could have been buying it for the family dog, it doesn't matter what she does with it, the fact is she paid, so she was liable, and only her.
Send the above letter along the lines of 'opinions for you''s posting, wave it goodbye in the post and ignore these callous sharks. They will likely keep sending the letters, but don't worry, the fact is your nan is deceased, and has left no estate or chattels. Therefore the contract is also deceased, end of.0 -
Ask them for the balance of the funeral costs........0

Ok, at first I was reading this with humour, but telling you to sell all her stuff to pay them back? That's disgusting.
Do as the others say, write a simple letter telling them to bog off, and if they don't do that then find out who to complain to and do it. (Personally, I'd start with the papers. But you're probably not in a good enough place for that).
They know you're grieving and therefore weak, and they're playing on that. What I think of them would get me banned if I typed it!Unless I say otherwise 'you' means the general you not you specifically.0 -

If you want to be polite you could ask them to review their advice and ask if they stand by that, ahead of you referring it to the Solicitors Regulation Authority0 -
Just want to thank everyone for their advice. Im really gratefull.
I also phoned National Debt Helpline and they basically echoed what all of you have said here.
The Loan was between my nan & DFS. Beings it wasnt HP my nan could do anything she wanted with sofa, she owned it from day one. Beings she has sadly died, left no estate, the debt dies with her. Its not no ones elses responsibility to pay off the remaining outstanding balance.
I will now write a letter off to the solicitorIt will be interesting to hear their response.
Thanks again :heart2:0
