Can you take courts to court??!!

Unbelievable! As if its not bad enough with companies these days treating their customers with no respect and lack of any decent service around, when you finally get round to taking action against them.........
Finally take Barclays to court for well... being Barclays (no, in all seriousness a valid case - please dont start saying I should have gone to financial ombudsman) Anyway, thats not the point......
Fill out the small claims form and deliver it by hand to the courts with cheque for their fee £80. They pay cheque in 18th September. Today, I think it strange why I havent heard anything. So I phone the courts. They have no idea who I am, what the case is etc etc. So I explain the name, the case and say they must know as they took the money for the court fee out of my account. He said he has no information on any such case and he'd phone back. Which he did after about an hour to say that they have lost my case and I need to re write the whole thing and re submit it. Obviously they were unable to inform me or refund me as.... they'd lost my details.
This took me ages, and like most people with work and family commitments time is a rare commodity.
Can they really get away with this? I now worry if I submit a complaint it may go against me. And what good would come of it anyway? Thanks

I would suggest doing a bit of reading up on the complaints procedure
You probably wont be able to take them to court as such but there may be a complaints procedure or a tribunal of somesort of the courts have cocked up to your disadvantage - although this sounds relativley minor mind.0 -
You can take the Courts to court but I wouldn't bother for this.
Just write to the court - make sure that the letter is headed as a complaint and make sure that you fully quantify any losses (don't just ask for compensation - you're unlikely to get anything unless you fully quantify it).
The complaints procedure has three stages. You should get a response within 10 days for the first two stages & 15 days for the third. The responses should tell you how to escalate to the next stage if you're still not satisfied.
In your case I would also ask them to clarify what has happened to the fee you paid - they will either be holding it in a suspense account or, if it's been processed as a fee, then they should be able to give you a case number (which is allocated when they account for the fee).0 -

If you credit check your local courts, you will be surprised to see they are registered as a trading entity and will already have several CCJ against them.

thanks for all your help, we arent going to take them to court literally but just put that as a title. yes I have heard that they are useless and have a habit of cocking up themselves. Will submit but time consuming have better things to do with time then waste it over their errors0

Well, after advice from you good people, we phone the courts and they tell us to resubmit it but dont pay any extra. So we did. They send it back to us telling us to pay the fee. I phoned to say it had been taken out of our account on 19th September. I even phoned the bank who confirmed it was paid to HMCS. The arrogant, so horribly arrogant and unhelpful bloke basically implied I was lying and said they have no record of it so it hasnt been paid and "why would they have paid it in and have no record of it?" WHAT TO DO NOW??? They are wasting our time and have our money??0 -
