In a bit of bother with WTC overpayments

Got a lovely letter from HMRC on Friday last wanting FULL payment of over £1300, overpayment over a couple of years... guess when they wanted the money? Monday.
Or else the matter will be immediately put before the SCOTTISH Sherriff's Office (I live in Cheshire).
Just written to them saying (I paraphrase!) come and try to get it! We ain't got it"!
Wish I'd never believed the original hype and not even applied for WFTC. Think I'd rather have scraped for gold using my bare hands.
If GB ever becomes PM, I'm off out of this place to somewhere where they treat politicians and government officials with the deference they deserve, ie., none. Besides, Greece is warmer.0 -

Where do I start, what a mess. Husband was setting up business so claimed tax credit 2003 and I statrted full time work, so got child element for nursery fees. Continued claiming until daughter kept falling ill and had to give up work for her health so informed Tax credits of change of circumstances immediately. Payments reduced. Oct 2005 received phone call saying we were overpaid by the princely sum of nearly £6,000. Immediately had heart attack! What on earth was going on? Couldn't understand it. Kept them informed of every minute change in our circumstances and used to get enough notifications to contribute to global warming fot the next 50 years! All notifications were slightly different and usually received 3 or 4 on same day! How are you supposed to know if they are correct or not, we are not mathematical scientists and do not know the formula used to work out how much you should get! After speaking on phone was told it was obviously a mistake on their behalf and not to worry but fill in an appeal form anyway which we did.Then received letter saying we definately owed them the money and ***HAD NO RIGHT TO APPEAL THE DECISION**** It has been going on ever since. Having little space we could not keep all correspondence from 2003, and when I requested copies of all correspondence I received a letter saying that it was dealt with by a different department and I would hear from them shortly!! Needless to say I have heard nothing. We have had a court date which I have asked for an extension to so that I can build a defence but quite frankly I'd rather go to prison than pay it!! Normal people have no way of proving they are in the wrong and they are banking on it to claw back the millions they have lost through their own incompetence. I am absolutely furious with them. They are a law unto themselves, they have harrassed and badgered us with continual threatening letters and my husband is close to having a breakdown. I refuse to accept it was our fault this situation arose and will not concede. They are just bullies and people need to stand up to them. We do not claim any benefits at all and are living on the breadline. They can try all they like to get the money but when you haven't got any to give, what do they do then?
Has anyone actually won in court against these people?
Sorry for the ranting, I can't be the only one in this position (Also 6 months pregnant and hormonal, you never know I may end up having baby in prison)!0 -
