I'm not sure that you have clearly answered the question about how the discount was applied. Were the shoes priced at £220, and then when you went to the checkout it showed a separate £110 discount and a final purchase price of £110? Or something else?

From what you've said and what has been found from the company's T&Cs it does sound like you could have a case, simply because they have failed to word the T&Cs in the watertight way that other distance sellers have. Quite how you'd force them to sell to you at the discounted price if they don't accept your claim I don't know, you might be able to get Trading Standards or your credit card involved but in the end it may have to be via Small Claims.

So how to the confirmation email worded.

For example, if it states 'This email confirms you have submitted an order with ___.' they could argue acceptance hasn't taken place yet and the supplier has infact rejected the order and not sent out a real confirmation email.

It would also be worth checking to see if their terms give them a get out clause in case of pricing errors or misued discount codes (and infact how you came about receiving the discount..)

it makes sense as people say, best to get your money back and move on....
For example, i have a company called "Rip you off dot com"
and i sell everything for 50% less than everyone else on my website..... so i get lots of buyers, and lots of payments....
the following day, i then email all the buyers saying 'due to a fault with the website', i am unable to process there order and due funds will be returned.

But as a business, i can take up to 'reasonable time' to refund my customers, so basically i hold onto there monies for like 3 weeks, put ALL the monies into small interest accounts, and then refund everyone 3 weeks later.
So as no-one has a leg to stand on, i make small money for nothing! :D:D:D

**Christane , if i were you, give Consumer Direct a call and see what they say, as you said, a contract is formed at the time FULL payment is made. Its doubtful you will get anywhere, but you never know, there might be some wording of law that states the company has to complete the order ?
  • Hi everyone,
    again thanks for your replies.

Ill try to work this out directly with Grenson, maybe they are reasonable enough to see my point.

Otherwise ill be calling Consumer Direct as suggested.

    Two things:

    1) most business bank accounts are either non-interest bearing accounts or have tiny interest rates. Interest rates are so low in general this would probably not be worth the hassle doing.

    2) Online contracts are not cut and dried confirmed when payment is made. Have a read of the Distance Selling Regulations. There is no law that forces a company to sell at a price they do not want to. It is their property.

Even a small % of a few £bn is a decent living - just think much much bigger than a few customers paying you £100 each!! :D
