Discount given is different to what was advertised.

A friend of mine recently purchased a ring and was told that she qualified for 20% discount. A few days later we noticed that they have begun advertising a discount for 40% a few days before her purchase. When querying they have basically said tough luck!

Does she have any rights?

You'll likely find it says "up to 40% discount". And technically, no she doesnt have any rights. It was a invitation to treat, she accepted, offered payment and they accepted payment thus a contract was formed. Providing this was in a shop and not online of course.

She could try reporting them to trading standards to ensure their campaign is legit (that people can get the 40% discount).

But from the sounds of things, she was happy with what she bought at the price she paid and she's only now having buyers remorse after seeing the 40%......is that correct?

Its the magic words 'up to' she probably missed that.

It would probably depend on the price of the ring as to what discount she got.
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • No it is a flat out 40% discount. She isn't having buyers remorse, she is obviously annoyed that everyone else is getting a 40% discount however she was only given 20%

Just ask them if they will do something for her (no right to really expect anything).

    It doesn't work that way.

She offered to buy it at a price (with the 20% discount) and the shop accepted her offer.

  • But surely if they are offering a 40% discount they are obliged to tell all of their customers that?

As above, its classed as an invitation to treat, no contract exists at this point. Ultimately, they offered a price, she accepted their offer, offered payment to that value and they accepted.

Also as above, she could try contacting them to see if they will refund as goodwill gesture. You could also try trading standards but if they are in fact offering 40% to at least some customers......the complaint may not be upheld.

They are not offering a 40% discount, they are inviting offers from customers at that price.

Just because an item has a price on it does not make the shop obliged to accept an offer.

When and how was the purchased made?
The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark
