Nursrey retaining deposit - can they do this?

    Perhaps not! Its down to the OP to decide if getting the money back now or a place at the nursery is more important.

    I do think that if the OP cancels the place for next year at the moment, the deposit should be returned (maybe less an admin charge), purely because neither the OP nor the nursery owner have been clear or quick about what is paying for what.

  • well, just called them again and they have told me that a cheque will be in the post (not holding my breath as have been told this several times before)
    the usual policy of the nursery is to contact you 3 months before your start date and confirm if they have availability and request deposit then. The whole fiasco is making me look into other nurseries, I find it a bit unnerving that the manager has always 'just stepped out' every time I call, and makes no effort to call me back, makes me wonder whether he is ever actually there. fingers crossed I will get a check this time, thanks for all your replies

    Why go to the nursery in person. He can't just step out then, especially if you wait outside for twenty minutes, befiore you go in.

    Time to put things in writing now i think, giving them a time scale of when you expect this cheque.

    you may want your child back there in a years time, but no one knows what will happen between now and then..
