Holiday Cottage let down. What compensation am I entitled to?

Had a half term break in a North Yorkshire coastal town which cost £800 for five nights. Cottage was a single level flat below two other floors which had two families with five children above. Sound proofing was non-existant and holiday was dominated by the movements of the family above, ie they rose at 5.30am and went to bed at midnight - sleep when they were active for us was impossible due to the noise. Rang company whose solution was to ring family above and ask them to keep noise down. This did not work. My "gripe" is that we were not warned about this - the visitors book clearly indicates that there was a problem. Company has offered £150 in vouchers to spend on another holiday with them. Does anyone think a claim would stand in the small claims court? Any advice?

    Nope I think you'd struggle. I'd try and negotiate the £150 as cash.

    I agree - I can't see how the owners can be held liable for children making noise. I also don't see what good an advance warning would do, is it not obvious that family holiday lets will be noisy at half term?

    Presumably you were aware it was a ground floor flat when you booked it, and if so, I think it could be argued that you could reasonably expect some sound from the inhabitants above.

    Personally, I'm afraid I can't see a small claim getting very far...

    I really don't see how the rental company can be held liable because they've let it out to a family who happen to be early risers.

    Presumably if they'd kept the same hours as you there would have been no problem. Did you knock and ask them to be more considerate?
