My medical was some time in April I think not sure would have to look it up. I was given 6 points in June then that's when I appealed against the decision. I didn't know this until I went to the appeal last week but I didn't get any points when I went for my assessment it was the decision maker that gave me the 6 points.
Yes I was reading the post you are talking about. You could be right about the secret number my friend told me she read in a newspaper they were trying to get it down to 100k or something like that.
That's the next thing I am waiting to happen is for them to look at my DLA.

They have used some medicals to reassess DLA claims but you should be ok as current DLA rules state that pain when walking counts as not being able to walk, PIP seems at present not to have but lots might change before its rolled out and they may end up with a similar criteria as now, we will have to wait and see.
I think the mobilising with virtual wheelchairs came in before the begining of April but someone will correct me if Im wrong, thats the daft criteria you will have failed on, you should wheel even if you dont have a wheelchair to be fair to us wheelies, I spent over a decade on crutches fighting wheelchair use!
Its normal to fight wheelchair use, I know its a daft thing to fluff your hands now but at the time no one could persuade me to use a wheelchair.Hi sunnyone,

When was your medical?
If it was under the new rules you will fail as (I kid you not) the old criteria was unfair to wheelchair users who work!
I have just been reading the PIP criteria and it looks like they are going to do the same there and take away HRM if you can walk, I think they will just keep changing the rules until they reach the secret magic number thet they have in their minds of how many disabled/sick people they are prepared to give benefits too.
You can claim again if the medical was over 6 months ago but they might not pay you until you "pass" a new medical or if you have grounds you can go to a higher tribunal, someone who understands the rules will be along to explain it more soon.

Anyone going trough through an appeal should look to see which descriptors were used for which ESA50 medical date.
- all medicals prior to 28/3/11 use the old descriptors
- all medicals falling twixt 28/3/11 – 28/9/11 can use / either / or / the old or the new descriptors, the ESA50 will determine which
- all medicals after 28/9 11 will use the new descriptors
Pay attention to this issue of when you filled out the ESA50, make sure the correct descriptors [ above ] were used. The new descriptor points are measly compared to the old points values !
So the date of the medical is the key date
