Hi, i am after some advice, my best friend is thinking of taking out a DRO.
I dont have much experience aside from my own bankruptcy.
She has 4 items with Bright House, one ends this August, 2 end in a years time and the last one about 2 and half years time.
They are for essentials, washer, fridge/freezer and sofas.
If she took out a DRO, would she need to give back the stuff to Bright House? or if she can get her OH to take over the payments but the accounts stay in her name, is this ok?
Thanks

I thought the purpose of a DRO was you didnt have a surplus income of over 50 pcm so how are they going to explain the a) transfer of debt, without the loss of goods and b) if it is transferred who it has gone to and that person connection , they dont want a perjury sentance. There are cases in the press where prison sentances have been given for dishonest statements from the outset to the official receiver which a DRO is managed by.
Personally why does your friend not ditch bright house, the stuff is rubbish for the amount they are paying, and by sticking with the likes is not demonstrating she is understanding why she is in a mess , Bright house intrest is in line with 200 apr etc . only a foolish person would stick with such arrangments. maybe get them to contact her local homeless team for places that offer new goods for a reduced price for those that are in financial difficulty, there are tons of places that work with the financially excluded ,
Your friend maybe be able to do without and buy second hand , TVs are a tenner in the paper, fridges are as a cheap as chips , washer machines are about 100 pound for reconditioned, maybe two months not paying brighhouse can be the actual solution not paying them.if only life was a box of chocs0 -

However, the 'power 'of a DRO only extends to the debtor that is under it, and no one can stop a friend/partner/family from taking over the payments, which would keep the goods safe.
Brighthouse, or any other HP provider might decide to exercise their rights to the goods and refuse to accept payment from a third party, but experience shows that they dont really care who pays so long as someone does.
Only the person under the DRO can be held to account for 'prefferential payments'.
