Do you think I'm entitled to high-rate care DLA?

    When asking for a review of a current DLA claim there are 4 possible outcomes:
    1 – The DLA rate is kept the same (no change)
    2 – The DLA rate is reduced
    3 – The DLA rate is increased
    4 – The DLA is stopped all together
    Even if you have a prima facie (at first instance) entitlement to High Rate (HR) DLA care then it all depends on the decision maker. I have seen many clients been refused HR DLA care and have had to go to appeal – tribunal. However, I have also successfully increased many clients’ DLA awards. If you think you meet the criteria for HR DLA care then visit CAB or welfare rights and discuss it further. You will have one month to appeal the decision. You will need as much evidence as possible if you ask for a review i.e. supporting letters from health care professionals. The main question is: do you have substantial and frequent care needs (personal or supervision) both day and night?

    OP, all of the care you've listed is day time needs. For high rate DLA you must have considerable night time care needs too.
  • What care needs do you have overnight? How often do you have night time care needs? How long does it take to care for you overnight, if at all?

    As GlasweJen says, your care needs appear to be daytime needs. To qualify for HRC, your needs must be day and night.

    Also, you state that you have to make a contribution to the day trips, so this implies that you don't pay the full amount in the first place.

    even severe agrophobic people can go out now and then.
    It may be part of cognitive therapy.
    How would an agrophobic sufferer ever get better if they never left the house?
    The "day trip" might be going to the post office or a friends house ect, not the seaside.
  • I think the pressing need for the OP is not a DLA reconsideration, but sorting out the housing situation. Sleeping on a friends floor is not sustainable, or good for ones mental health! Go to the local authority and present as homeless.
