Using Moneyclaim

Well I managed to get £475 back from MBNA but wondering if it's worth using Moneyclaim to try and get some money owed from E2Save? It's only £42.66 but is owed since last October as part of their cashback scheme having bought a new phone from them. They admit I sent the right bill, but try as I might I can't get the cash out of them. They 1st of all said they'd sent the cheque and I'd have to wait another 6 weeks, then again the same thing. Now I'm just getting nowhere with them, letters get ignored and phonecalls are a waste of time, they just delay it yet again.
What happens if I put in a claim with Moneyclaim, costing £50 then they send the money as soon as they are served the notice. In effect I've gained £42 for a cost of £50. Does anyone know the way around this please, little as it is, I want my money on principal if nothing else. Thanks Steve.
