If it was that important to you then perhaps you should have actually checked it was working before you bought the car? That is your responsibility before parting with the dosh isn't it surely?
From the other perspective you say that the salesman was aware that it was important to you. Did you specifically ask him if it was working and did he specifically say yes?

No but then again I didn't specify test I said check it was working and I also didn't specify the time of day either. But if that (possibly quite reasonably) was a problem please refer to my second paragraph. If the answer to both questions is yes and you have a witness then you have something to go after them on. If you didn't ask and just made an assumption then the principle of caveat emptor comes into play and I guess you are going to be paying the bill.

Do you have windscreen cover on your insurance?? Could you be driving down the motorway when a stone jumps up and cracks your windscreen by any chance?? It does happen. Around £50 excess to pay beats the £5000

They go wrong a lot. We had a Ford Fusion, brand new and by the time that went only about half the window worked. Stone chips etc can damage the elements, plus despite keystone's back pedalling they aren't used that much for most of the year and most things suffer with a lack of use. As far as the garage is concerned it is probably classed as working. I doubt you'll get a new screen from them sorry.

Again, thanks for the responses. Nope, I didn't specifically ask whether the front windscreen was working, as I took it in good faith that it would be. Fortunately I'm happy to report that the salesman spoke to his director, and they have agreed to a new screen.. it's being done on Tuesday.
