Freezer Broken Down

Have put this post on Insurance and Consumer Rights board as not sure where it fits.

I bought a new Fridgefreezer in April of this year from Curry's and the freezer broke down yesterday.

It is covered under a standard years warranty which comes with the appliance so they are coming out to have a look next Tuesday (the website says in 2 working days) but I have lost a freezer full of shopping.

I have £100 excess on my contents insurance and the food was probably only worth about £75 so can't claim but it's a lot to lose!

Where do I stand with claiming anything back from the retailer?

Any comments would be gratefully received.

  • Not sure advocating fraud is really the best idea. Is £75 really worth getting a criminal record for?

    The excess isnt always applicable to the frozen food section of the policy so worth checking that but most require it to be "accidental" in which case the freeze developing a fault may not be considered an accidental event.

    I would argue that if Currys have provided you defective goods and that breach of contract has directly resulted in your additional loss (ie the food) then you would be entitled to add that to the claim against them.

    Not only is it insurance fraud, I wonder how much more op's home insurance would cost them over the next few years as a result -- and whether than £75 now looks worth it.
