Help with Itouch

I am hoping someone can help me.

I have a itouch 32gb version, and it has stopped working.

It is a little under 2 years old, and it cost well over £250.

i took it to the shop, and there said it was broken and it would be replaced for £119

i tried to argue the sell of good acts to say it should of lasted longer then 2 years, but there were having none of it.

it was a £119 for a replacement one or 10% a new mobile if i traded in the broken mobel

is there anything i can do along the lines of the sale of goods act, or do i just wrtie this one off.

    Are they saying they'll let you buy a new one for your old one plus £119?

    Which model Ipod Touch is it? (I have the 32GB 4G which cost about £230 in January this year. A quick Google shows it is still selling for the same price).

    On the assumption we are talking about the same model, you are being effectively offered £110 for your broken one. Whilst you could push for a little higher refund value there are 2 considerations:

    1. They are allowed to offer a partial refund to account for your usage, and their offer is within expected levels;

    2. After 6 months the onus is on you (the consumer) to prove an inherent fault (via an engineer's report which you would need to first pay for then get refunded if the report found in your favour), not the other way around. It seems they are not requiring you to do this, thus saving you that hassle and risk.

    All-in-all, seems reasonably fair IMHO.

    its a 3g one

    i am on the said of agreeing and calling it a loss and binning the thing,

    it may be better to buy a new 8gb 4g one for £149 and get the full 1 year warranty with it.

    as there said, i give them this one, and i will get another one like for like for £119 but with only 90 days warranty.

  • Which "shop" have you taken it into?

    Whilst your rights are with the retailer you bought it from Apple are known for their good customer service and have been known to fix or replace things FOC even outside of warranty. If it isn't an Apple store and there is one close enough to you then make an appointment and their Genius bar and take it in to see what they say.

    In that case I'd be tempted to push for the partial refund of £110 ish (NOT as a part-exchange deal) and use the cash towards something that will give a full warranty.

    If they're only giving 90 days warranty then this sounds like a refurb, so paying £119 does not sound like a good deal.

    i took it into a apple store, and was there for over a hour for them to check it.

    the offfer for just a brand new replacement (but with only the 90 days warranty) or trade in for 10% off.

    that was it, take or leave it.
