Lowell Group and Bankruptcy Petition

Can anyone help? I was contacted by Lowell demanding money for a credit card debt,I followed the advice on this forum and wrote to them to say I did not acknowledge the debt and requesting copies of the signed agreement I have not received this.I have now had a bailiff at my door who has handed me a "creditors bankruptcy petition on failure to comply with a statutory demand for a liquidated sum payable immediately" it is due to be heard in court on 17th November.Can anyone advise on what I should do next? The debt is for an egg credit card and is approx £6,000.

Hi, have looked at the info on having statutory demand set aside but think ive run out of time? Can I contact anyone (lowell or court)to ask for more time? Should I just turn up at court and plead my case? Really dont understand why this is happening,I am a single mum with 3 children and work full time to be able to just about pay the mortgage and put food on the table,I have very few assets and am not sure what they think bankruptcy would achieve,please can someone help.0

Is there a lot of equity in the house?
When was the debt taken out?
When did you last pay towards it?

Would really appreciate some help/support/advice as kind of at rockbottom! My ex partner and I split up 6 years ago after 10 years of living a good life! He walked taking with him shedloads of debt most of which I was unaware of. He left me a property with a joint mortgage contributing nothing and is continuing to live the good life.I have struggled to meet day to day demands (mortgage,bills and supporting our 10 yr old son) I work full time to do this.Anyway sorry to waffle but today I received confirmation that a judge had declared me bankrupt! Hamptons plc had applied for bankruptcy on a £6000 debt to egg and the judge had granted in there favour.They had contacted me about the debt and stupidly I had buried my head in the sand ! The letter from the court has asked me to contact the official receiver.I am distraught! Please can someone give me some advice,I have struggled for the last 6 years to pay the mortgage on my own and there is currently approx £130,000 equity in the property,I have no idea where my ex partner is and for the last 4 years have been with a new partner who has no idea of my situation (embaressment?) but is now living with me with his 3 primary school age children and we have a joint account that the mortgage is paid from.Sorry rambling but so,so upset that I cant think straight.0

You need to talk to your new partner as soon as possible. Any joint accounts you have with them will be affected by your bankruptcy. You won't be able to keep this from them any longer.
You need to stop ignoring things and face up to whats happened. Don't want to sound unsympathetic but now is the time for you to get everything out in the open and start afresh.

Please try these they don't charge and are impartial. They will go through all your options with you and if they suggest bankruptcy then come back to this board and we will help you all we can. Also if your not ‘clicking’ with one of the Debt charities do try another. We advise you to try at least two others for your own piece of mind. Your BR could be refused if you have not sought advice.

Hi Hopfarm, can you give some more details of your situation, we know about the house, what other assets do you have, do you work, have an income and what are the total amount of all debts that you owe, with that amount of equity there may be some options byt that will depend on the crcumstances of your case.
Finally you need to make sure you cooperate with the Official Receiver, so you need to give them a ring
Forgot to say, is there any reason you can think of that the equity in the property would not be split 50:50, ie were you married, did one or other put a big deposit down, did one primarily work and the other not whilst you were togetherHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

I work fulltime and earn £25,000 p/a my total debts are around £20,000,I have been paying the mortgage and supporting the household on my sole income for 5 years,The mortgage is in joint names with my ex but the original deposit for the house was put down by me (approx £35,000).The mortgage is £120,000 with 15 years to run and the house is worth approx £270,000.I will contact the relevant people but at the moment I am gutted and extremely upset that this is happening.Thanks for the advice so far.0

Hi,still very confused! Came home today and FO telling me that they would see me on 6th June lots of forms enclosed that I need to complete and bring with me.Other half needs to be told and I will address this soon.Will I see anything happening before 6th June (bank account frozen etc) Can anyone advise on what they might do with my property,lots of equity but joint mortgage,think I can live with anything apart from loosing my house which I have worked so hard for to enable my children to be secure.Feel such a fool.0
