Euro Car Parking

Hi All,
I'm new on here, so apologies if my post has been covered before?

I received my first ever Parking Ticket today.

In brief, I called into a Morrisons Supermarket (Ormskirk) to grab a coffee. when I came out I had a ticket from Euro Car Parking for failing to display a 'Pay & Display' ticket.

My 2 local Morrisons (New Brighton & West Kirby) are both both free parking, and if I'm honest, I've never been to a Supermarket where they charge to park in my life (I'm 38).

My car is a Company Car, so I guess they'll contact Lex first to find out my details. When they do find my details, and start writing to me, what do I do? I've been warned that if I don't pay, they could issue a CCJ - is this correct?

Any advice would be gratefully accepted.

Private companies cannot "issue CCjs". Only the court can do that. before that happens the case has to go to court (very unlikely) you lose (very, very unlikely) and THEN you refuse to pay whatever the judge orders. This is such a remote possibility it's not worth worrying about.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

First, read the stickies and understand that it's not a fine, it's an unenforceable invoice which you should not pay, and most of all, it's all a scam.

It is important to make sure your company car lease/fleet management company/Lex DO NOT pay this and then pass the charge (plus healthy "admin fee") on to you, which is a common occurrence, at which point you could get into all sorts of grief with the fleet managers/HR etc.

So, check the Ts&Cs of your company car agreement. It probably says that all fines and penatlies will be charged back to you, e.g. Council Parking tickets. However, it is important to understand that this is not a fine or a penalty, so does not fall under such a clause (many fleet companies fail to understand this).

You must contact whoever is the registered keeper of the car (Lex, I assume). Make sure that they simply pass the junk mail that will arrive regarding this straight on to you, and NOT to pay up. Strictly speaking, they should not divulge your details to the PPC (under data protection), but that is another mistake they often make. They may get fed up with the increasingly threatening letters that arrive, but you must be persistent with them.

Oh, and once you get the forwarded PPC correspondence - just ignore it. Do not reply.

The only important info is in bold - it's a company car so do not sit back and guess what might happen next.

What happens next with many lease cars is that their Fleet Managers just pay fake PCNs along with real ones. Then you would get charged plus an admin fee - or risk the wrath of your company if you object after the event. Please don't wait until it's too late and the scammers have just been paid at your expense.

What you MUST do is flag it up very clearly now by telling the Fleet Managers from both companies (your firm and Lex) that there's a scam ticket and letter-chain coming their way and you will not be paying it under any circumstances. You need to word this very carefully and give them lots of info if they need it.

Send the Fleet Managers this link but that's only for starters:

    http://www.fleetnews.co.uk/news/2009/5/28/...ts-urged/30698/

And also you could construct a covering email or letter copied from the brilliant emails used by this poster to send Sixt car hire scuttling to their Legal Dept then giving up:

    http://forums.pepipoo.com/index.php?showtopic=62531

That thread gives you all the info to use to explain to your Fleet Manager and to Lex, why this is actually none of their business, not their liability.

Then, there is this (thanks to Broadsword and axeman on pepipoo who I quoted):

''Point your Fleet Manager and Lex in this direction and use the search box for 'private parking tickets':

    http://www.bvrla.co.uk/

and ask them to read the top 4 articles and use this letter (second one)

    Private parking letter one (Private_Parking_Ltr1.doc)

...and as the company car is leased, suggest that the Lease co. just email their concerns for attention of Jay Parmar in the Legal and Policy Dept, as this (BVRLA) is the trade body for lease cars. He knows and understands exactly what private parking tickets are all about, they should accept his wisdom on the matter.''

Do not do nothing and do not just raise it within your company, you must contact Lex and not just by phone. I am 90% sure you will find Lex might be dumb enough to pay the fake PCN (or maybe not that dumb, it's easier for them just to pay them all and gather admin fees to boot!).

    HTH
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
