Can they use reclaim against my debt?

Tesco have agreed which is wonderful. However they are saying they'll use it to pay off some of my debt. I don't want them to do this as I have several debts to service and surely its my money so I get to decide? my account with Tesco is cancelled and im just paying minimum payments so Im not in arrears. can they do this?

  • Yes they can, they need to put you back in teh position as if you never had it - so they can allocate some (or all) of the redress payment to your outstanding balance. The FOS agree with this.

    Thanks for that CS2. At least it's one debt thats significantly reduced! Bring on the other claims!

    could you give me some info on your claim?

    i'm claiming on four loans from Tesco Finance (taken out between 2001 and 2004). it's been 21 weeks since they acknowledged my claim, and i've heard nothing - neither a positive or negative reply.

    if you could give me some details of your claim, i would really appreciate it.

    There's not a lot to say really! Was a credit card and I was told that I had to take ppi if I wanted it. I sent in the form and they agreed they couldn't prove they had given me correct info or that they had given me a choice about ppi.

    They gave me an answer within 3 weeks of acknowledgment of claim and have always been good to me. Unlike Lloyds and BOS who have not made a decision yet and that's 6 weeks ago.
