Esa appeal one 3 weeks laters recived esa50

i won my esa tribunal 3 weeks ago, based on the OLD rules regarding walking,this morning i have just recived another esa50! i have just rang them up and they have confirmed they are having me reaccessed just when i thought the worry was over :(

Now i understand the new rules are different to the old walking rules they are how far you can mobilize :(

I am a wheel chair user and i have no problem using my wheel chair BUT i can not get in or out of my wheel chair without help from another person.

I have a part time career who helps me out as much as they can but they are not available 24/7 as she is a house wife with 2 young children however she lives local and in the case of emergency she is always able to help out.

The thing is if they fine me fit for work, unless i have somebody at home to help me in and out of bed,dress me and in and out of my wheel chair, i would not be able to get to work everyday and also while at work i need somebody to help me in and out of my chair to use the toilet.

If they find me fit for work will they provide all of the above help for me?

    No they will not provide the care for you and you WILL be expected to travel to work or to the job center to sign on.

    If you can only mobilize in your wheel chair you will be expected to get in this your self even if your physically unable to do so.

    Thats pretty much what the new rules say. while you have a good argument in not being able to get in or out of your chair alone atos wont be interested in this when they click you can mobilize without a problem on their computer, expect to have to go through a whole new appeal with another 12 month + waiting time just to be heard buy hey look on the bright side it will be 2 appeals for you with a 3 week gap inbetween im guessing you waited around 12 months for your last one like most people? so thats 2 years out of your life filled with unneeded stress and worry because the so called health professionals made an incorrect decision but hey just remember this is all to save the country money all the suffering us disabled people are going thought is all for a good cause and thats all the matters :-)

    You're 'lucky' - the new rules specifically address this.

    'Standing and sitting' 'Cannot move between one seated position and another seated position located next to each other without receiving physical assistance from another person' - 15 points. In addition, there is an identically worded descriptor for the support group.

    So, it would seem that - providing you can prove you cannot do this 'repeatably, reliably and safely over the course of a work day' (paraphrasing various regs) - you are eligible for the support group.
