  • We have had numerous court letters, bailifs coming around and even trying to break in or threaten to take the vehicle outside our house.
    Write a letter for each organisation involed. Address it to the 'Data Protection Manager' and the organsations address.

    Say in the letter you are concerned, and that they are confusing you with the previous occupier. Say in the letter that you believe that have breached the Data Protection Act, and that under Principles 3 and 4 of the Data Protection Act 1998 that they are required to hold accurate, relevant and non-excessive data. Say that you are giving them 14 days in which to correct their records and leave you alone. Warn them that you will take further action against them if necessary - after which time you will contact the Information Commissioner to ask for a formal assessment of this case to be carried out under Section 42 of the Data Protection Act 1998 (you can do this online at https://www.ico.gov.uk). State in the letter that you reserve the right to discuss compensation with them, and that you expect a resonse from them within 14 days.

    If they fail to resond, complain to the Information Comissioner who will make a ruling.

    Legitimate baliffs will make a note of your registration number and check with the DVLA who owns the vehicle.
