Whilst in the OP's case this may be true. I have been awaiting a repayment for a client from his P35, submitted back in May.
HMRC refuse to pay any CIS refunds without the request of the client. We do this on their behalf and normally include said magic word. HMRC came back to us and said that we need to prove hardship so it can become a priority - seems they've smartened up to the old tricks!0 - 
            Strictly, for the tax year in question UK tax residence status - unlike most countries - is defined by case law so a bit of a movable feast. However, the good news is that from 6 April 13 all of this is being replaced by a proper statutory residence test as follows:

This test in effect codifies a whole body of cases dating back over 100 years. If you are conclusively non-resident or resident under this new test - Parts A and B - I think you can justify leaving it at that.
You'll probably find yourself looking at Part C though, which becomes a bit more wooly. But at least if you run through this test you have something to go on, should you decide you were non-resident and HMRC come calling at some later date.Hideous Muddles from Right Charlies0 -

            realise this is an old thread but im having the same problem. i filled my sa out online then THEY told me that i had overpaid, so i asked for a repayment, 48hrs then another 48hrs etc..... did you have any joy in the end ?0

            i am due a tax refund post redundancy. I filled out a p50 and supplied all p45s etc by post to HMRC Liverpool. This was advised as opposed to online requests?

            Hi, I know this thread is a bit old. I am getting the same problem as some others.
I have some overpaid tax due, but when I request payment online, it says it will be processed after 48hrs. But then after 48hrs it resets again, so I have to go throw the same process.
Does anyone know the reason for this?

            I have been waiting 17 days for a repayment from a self assessment return with HMRC for £602.47. It has changed to repayment pending now, 3 days ago. Should I contact HMRC to see how long it will be before it is issued? I am a bit worried about contacting them, as I was once told that if you contact them, this could cause them to look into your return a bit more closer, which would cause another delay in them paying me. Is this true? I have been told try not to contact them unless you really have to. It is best not to be noticed by them. What would you say?0

            i have submitted the repayment request 3 times to no avail. says 48hrs each time, its saying payment not yet used under the allocation bit rang up and they are sending it to payment team to be done manually is this normal or security checks0

            See other threads where I have posted on HMRC slow pay tactics. Please note that HMRC operate a different time system to the rest of the country, known as the geological time system. So 48 hours is typically 7 days. 31 days is typically 3 months. You get the picture I hope.Hideous Muddles from Right Charlies0
