Ebay grumble

I recently bought a dress off of ebay which was used but described as in excellent condition. When I received it, I contacted the seller as it had a black mark on one side and catches on the material. I asked for a refund which then sparked a debate as to what you would expect from an 'excellent' item and then I had to argue with the seller to help towards the postage cost back to him. I have contacted the seller again and the dress appears to the lost in the post. I am really not happy, should the new dispute with the Post Office lie with the seller or me? I have proof of postage.

Did you go through the resolution center?
Unfortunately, proof of postage isn't enough for ebay to favour with you - you need proof of delivery.
But with the proof of postag you can at least make your own claim to Royal Mail.0 -
I didn't go through resolution centre. I just don't see why I should have to make the claim with RM as I will be out of pocket for weeks/months whereas the seller get's off scot free. I am really frustrated that I have been mis-sold and item, have to argue to get the refund then it goes 'mising' I have no dress and no refund. Hindsight is a wonderful thing!0

Unfortunately by not choosing recorded delivery to treturn the item, you've made claiming compensation your responsibility.
Even if the seller miss-sold you something, it's not their fault that it's gone missing in the post.0 -
Unfortunately you should have sent it back tracked, if a seller misdescribes an item then they aren't possibly the best seller. You need to be able to prove that they received it back.
It will be down to you to claim from RM as the sender.0
